Labor Day Weekend—Play It Safe on the Road
According to a recent WSMV investigation, a former U.S. attorney from Kentucky has become the eighth driver arrested for DUI by the same Tennessee State Trooper—despite being completely sober. That’s right: innocent people arrested.
It’s stories like these that remind me: even one mistake—or worse, one mistaken judgement—can spiral quickly. And brings back a case from early in my career… the very first DUI I defended was for someone who had never touched drugs or alcohol in their life and they were close to retirement age. Being sober didn't save them from the system—but it did teach me just how easily such mistakes can destroy reputations.
If you find yourself in the situation this lady was in, be sure to ask for a blood test. Alabama has several ways to charge those under the influence of controlled substances (.08 or higher BAC, under the influence of alcohol, controlled substance, alcohol and controlled substance, under the influence of ANY substance which renders the person unfit).
This Labor Day weekend—whether you're heading to the lake or firing up the grill—please don’t take chances. Impaired… or sober and misread, unsafe choices like driving distracted, after stress, fatigue, or minor crashes can trigger unnecessary legal consequences. Know your limits. Plan ahead. Designate a driver. Use rideshares. Look out for one another.
