⚖️ FEDERAL COURT ORDERS USCIS TO RESUME PROCESSING CERTAIN IMMIGRATION CASES

A federal judge has blocked portions of a USCIS policy that had resulted in delays or holds on some immigration benefit applications.

The court ruled that USCIS cannot indefinitely suspend adjudication of applications without proper legal authority. As a result, certain cases that were previously delayed may now move forward.

This development may affect:

✅ Green Card Applications
✅ Adjustment of Status Cases
✅ Employment Authorization (Work Permit) Applications
✅ Asylum Applications
✅ Naturalization Cases

While the full impact of the ruling remains to be seen, it is encouraging news for many individuals and families who have experienced lengthy delays in the immigration process.

If your case has been delayed or you have questions regarding how recent USCIS policy changes may affect your immigration matter, our office is available to review your options.

IMMIGRATION UPDATE: GOOD NEWS FOR ADJUSTMENT OF STATUS APPLICANTS

Over the past week, many immigrants, families, and attorneys expressed concern regarding USCIS's recent memorandum discussing the agency's discretionary authority in Adjustment of Status (Green Card) cases.

When the policy was first announced, many feared it could represent a major shift in how green card applications would be adjudicated. However, recent reporting suggests that the memorandum may be far more limited than originally believed.

According to statements attributed to government officials, the memorandum appears to be intended primarily as a reminder of USCIS officers' existing discretionary authority rather than a sweeping change in immigration policy.

What does this mean for applicants?

At least for now, there is no indication that every Adjustment of Status case will suddenly be subjected to a dramatically different standard. Applicants should continue focusing on what has always mattered: submitting complete applications, providing strong supporting documentation, demonstrating eligibility, and presenting favorable equities whenever appropriate.

That said, uncertainty remains. The true impact of the memorandum will depend on how USCIS officers apply it in practice over the coming months. As with any new policy guidance, it is important not to overreact to initial headlines—whether positive or negative.

My advice remains the same:

✔ Prepare the strongest case possible
✔ Maintain thorough documentation
✔ Be honest and consistent throughout the process
✔ Document favorable factors and equities where applicable
✔ Avoid making major decisions based solely on speculation

USCIS has issued a new Policy Memorandum that significantly impacts Adjustment of Status (AOS) applications filed in the United States. This change imposes a higher standard for the "exercise of discretion" by USCIS officers, meaning that even if you meet all legal requirements, your application could still be denied at the officer's discretion.
**Key Impacts of the New Policy:**
* **AOS Characterized as "Extraordinary Relief":** The policy departs from long-standing practice by labeling AOS as exceptional rather than a common benefit, despite historical expansion of the provision.
* **Adjudicators Must Weigh Totality of Circumstances:** Officers are directed to consider all relevant factors, including the availability of consular processing abroad, to determine if a favorable exercise of discretion is warranted.
* **AOS DENIAL RISK:** Maintaining underlying nonimmigrant status (like H-1B or L-1) during a pending AOS is highly advised. Relying solely on an AOS-based Employment Authorization Document (EAD) could expose individuals to higher risks if their AOS is denied and they have no alternative valid status. Removal proceedings could be initiated for those who overstay authorized periods.
**What This Means For You:**
It is essential to understand the potential risks and to consult with experienced immigration counsel to strategize and maximize your chances of success under this new policy. The Law Firm of Kyce Siddiqi is here to help you navigate these complexities.

Immigration cases are often some of the most stressful and emotional experiences families go through, and I never take lightly the trust clients place in my office.

Whether it involves adjustment of status, waivers, asylum, consular processing, removal defense, or family petitions, I truly appreciate every client who took the time to share their experience.

Thank you again for the continued trust and support over the years.

Today, we celebrate the strength, sacrifice, love, and resilience of mothers everywhere.

As an immigration attorney, I have seen firsthand the extraordinary lengths mothers will go to in order to protect their children and create a better future for their families. Whether crossing oceans, rebuilding after hardship, or simply showing up every single day with unwavering love, and mothers are often the foundation of hope.
