Three successful clerk's hearings in the past two weeks. No arraignments or charges will proceed against our clients. The lesson to anyone charged with a crime that receives a summons in the mail is to seek a hearing before a clerk magistrate and hire competent counsel.

My name is Nicholas J. Carbone, Esq. I am sending along the following letter from the Executive Director of the Disability Law Center where I am a member of their Board of Directors. I am asking that you consider supporting the Disability Law Center and join us at our annual gala. Please read on for dates, locations, and how you can become a sponsor.
For forty-five years, the Disability Law Center, Massachusetts’ Protection and Advocacy agency has been serving the Commonwealth and its residents. Founded under values that promote self-determination, integration and inclusion, the Disability Law Center, a private non-profit organization that provides free legal assistance and advocacy, fulfills a unique core mission of ensuring that people with disabilities are free from abuse and neglect enabling them to participate in the social and economic life of Massachusetts fully and equally.
Over the past five decades, DLC has challenged discrimination against people with disabilities and helped them obtain the services they need to fully enjoy participating in and contributing to their communities. DLC has helped people with disabilities and their families obtain the services they need to enjoy the things in life that most of us take for granted. For example, DLC helps people obtain housing, healthcare, education, transportation, employment, and other services they need to live independently in the community.
Looking back at our journey, I am proud of the work that we have done to effect positive social change through our litigation and advocacy.
The wheels are now in motion to celebrate this important milestone with a 45th Anniversary Celebration at the Royal Sonesta Boston in Cambridge on May 9, 2024. We will be honoring individuals and organizations who have improved the quality of life for individuals with disabilities in Massachusetts.
The proceeds of DLC’s Benefit & Auction will be used to help provide a variety of services for people with disabilities in Massachusetts. Our goal is a fully staffed and funded Disability Law Center. That is the only way we can fulfill our mission.

A lease is a contract between ALL parties. In our experience, a written lease is never simply memorializing rent owed. It is usually hyper specific as to provisions the landlord and tenants must both abide by. Non-adherence to any terms of the lease, expose any party to liability. Please call our office to draft, negotiate terms, or litigate lease violations.

When considering whether to admit to sufficient facts and accept a continuance without a finding (CWOF) via the 24d program on a first offense for operating under the influence, know the options and ramifications. For instance, although a CWOF results in a dismissal, insurance companies typically view this disposition in the same light as if a conviction was imposed after trial. Just because you get a CWOF does not mean you will save money but there may be other benefits. Call us!

When your tenants are having a tough time paying for utilities due to tragedy or loss of income, encourage them to apply for assistance via their utility company, state agencies, or various nonprofit organizations. Help is available but both you and your tenants must be proactive.

Reading police reports or overhearing Defendant's make admissions on the record makes it very hard to not scream out "Shut the F #$% UP!" Exercise your rights to remain silent and to an attorney. Call us before you put your foot in your mouth.

“He said, she said” cases are typically enough evidence for charges to issue and the government to prosecute. Hire a law firm with experience trying these cases.

Refusal of a breathalyzer or blood test may be a good move when under arrest for Operating Under the Influence (OUI). This may be good because the prosecutor must prove that you are either operating with a blood alcohol content (BAC) of 0.08%+ OR that you were operating under the influence which is more difficult to prove. If you refuse, your BAC is impossible to discern so that element gets knocked out. HOWEVER, a refusal results in a 180-day loss of license and if you do take the test and fail, the suspension is for 30 days.

About Me

Prior to going into private practice, Attorney Carbone was a partner at at law firm in Fitchburg, MA, an associate at a law firm in Worcester, MA, a 3.03 prosecutor in District Attorney Joseph Early’s Office, and also served as an intern for the Honorable Judge Timothy Hillman in the United States District Court. Attorney Carbone possesses experience and an excruciating work ethic that is evident in all cases that he works on. He is admitted to practice law in the Commonwealth of Massachusetts as well as in the United States District Court. Aside from the practice of law, Attorney Carbone is very active in his community and partipates in many pro bono programs. He is a former City Councilor and School Commitee member and currently serves on the Disability Commission for the City of Fitchburg and on the board of the Northern Worcester County Bar Association. In his free time, he can be found spending time with family, traveling, and enjoying the arts.

Attorney Carbone earned his juris doctorate from Massachusetts School of Law in 2012 and a bachelor of science degree in political science from Fitchburg State University in 2009.
