The Hirzel Law team had a great time at the Community Associations Institute Law Seminar, where Kevin Hirzel presented the Case Law Update for the entire conference of nearly 1000 attendees, Matthew Heron presented the CIRMS case law update, and Kayleigh Long presented "A Delicate Balancing Act: Guiding Communities Through an Increasingly Regulated Solar and Environmentally Conscious Landscape." The Hirzel Team was well represented by Kevin, Matt, Kayleigh, Brian Feldman, Jeremy Fernando, Sarina Saravi, Livia Khemmoro, and Michael Pereira. The Michigan Supreme Court has drawn a clear line on conditional rezoning. In Jostock v. Mayfield Township, the Court held that conditions cannot be used to authorize land uses not already permitted by a zoning ordinance. Municipalities must keep conditional rezoning within the scope of existing permitted or special uses, and developers cannot rely on conditions to create new ones.

For both local governments and property owners, the decision underscores the need to follow the proper legal process when a desired use falls outside the zoning ordinance.

Kevin Hirzel, Kayleigh Long, Michael Pereira, and Livia Khemmoro attended the Summer Conference of Real Property Law Section (RPLS) of the State Bar of Michigan. Kevin was the co-chair of the conference and had the please of introducing Michigan Supreme Court Chief Justice Megan Cavanagh, who delivered the keynote speech. Kayleigh and Michael had great presentations on short-term rentals and the Homeowners' Energy Policy Act!
