Creating a trust is a great start, but it won’t actually help you avoid probate unless it’s funded. That means your assets need to be properly titled in the name of the trust or connected to it in some way.

A lot of people don’t realize this step is just as important as signing the trust itself. If it’s not funded, your family could still end up in probate court, which defeats the whole purpose. Taking a little time now to review your accounts, real estate, and other assets can save your loved ones a lot of stress later.

However, the type of assets your have should inform if they are actually in your trust or just tied to it in some way or else tax consequences could result.

The Caravan of Hope is a traveling LGBTQ+ legal clinic, and they will be in town for one day offering pro bono legal support and resources for LGBTQ+ folks and our families.

Ever wonder what the real difference is between a beneficiary and an heir? It’s one of those estate planning terms people hear all the time, but it’s not always clear what each one actually means.

A beneficiary is someone you’ve intentionally named in your will, trust, or even on accounts like life insurance or retirement plans. You’re choosing exactly who gets what, which gives you full control over how your assets are handled. An heir, on the other hand, is someone the law recognizes as your closest family member who would inherit if you pass away without a will. In other words, beneficiaries are picked by you and heirs are picked by state law.

Understanding this difference matters because if you don’t make your wishes clear, the law will step in and make those decisions for you.
