AVOID PROBATE OF YOUR HOME. You can name a person to transfer ownership of your home upon your passing. Designate your adult children or anyone you choose. No probate needed. The person you name has no rights to your home while you are living. Fees to set up about same as preparing a deed.

MARRIED COUPLES. AVOID PROBATE OF YOUR HOME. If married and own a home, be sure deed has both names AND after your names the words, "for their joint lives, remainder to the survivor." Then 100% ownership passes to surviving spouse. No probate. If your deed lacks this language, probate necessary for surviving spouse to become 100% owner. Not to worry, it is simple to correct a deed.

YOU DON'T NEED A LAWYER for some simple estate planning. You can go to your bank and designate a "POD" (pay on death) on bank accounts, even a simple checking account. Then the balance in the account will transfer directly to your named person and not go through probate when you die. No Will needed. IRAs, investments, other accounts you can do the same. If you think you might not outlive the life of your car (!), you can designate a beneficiary on vehicles at the BMV for $17. Your car will transfer to your named person when you die with no delay or expense of probate.

GIVING SOMEONE THE POWER, THAT IS POWER OF ATTORNEY (POA). Typically as part of life planning, we should all appoint an agent to handle banking and other personal and financial matters for us. Just in case in the future we are ill, we have dementia, an emergency, or other reasons. Usually we name a spouse or an adult child. The POA can be "durable" meaning it remains in effect even if we are mentally or physically incapacitated. The POA can be limited, example to just bank accounts, just car titles, or just real estate. Or it can be written to cover most everything that could come up.
Fees usually $100 or no charge if part of other estate planning.

HEALTH CARE POWER OF ATTORNEY (HCPOA) vs LIVING WILL DECLARATION (LW). HCPOA means I appoint an agent who has authority to make health care/medical decisions for me. But only if I cannot do so for myself. So doctors will ask me first, not my agent! These may be routine decisions not just life/death decisions. Example, routine surgery and while on the table the doctor has questions, can ask my agent. Example, I am unconscious and there are choices for care or hospital, my agent can decide. Example I have dementia, my agent can talk to doctors and make decisions for me. LW means I declare for myself "pull the plug" if 2 doctors agree I have passed but being kept breathing by life support. We all should have a HCPOA, personal choice as to also a LW.

SO WILL YOU OR WILL YOU NOT MAKE A WILL? We all put this off. My office is open and gotten some anxious calls this week. I have distancing precautions in place. I can also assist with estate planning by phone. Most of the time planning is simple. Two parts: LIFE planning such as a power of attorney for financials and health care just in case. DEATH planning (not for many years to come all hope) which is a Last Will and Testament, sometimes a Trust, guardian for children, and designating beneficiaries on accounts, cars, real estate, etc to avoid the time and cost of probate. Fees for all life and death planning typically about $500 a person or couple, might be more if minor children.

LAWYERS MAKING MONEY OFF OF YOU if you are injured as a Bird or Lime scooter rider. I only handle family law cases but some lawyers are advertising for scooter injury lawsuits. Hospital visits are on the rise for bone fractures, lung contusions, dislocations, and most common head injuries. Lesson is riders be safe, consider a helmet. Else you just might make a lawyer happy!

ATTENTION PARENTS PAYING OR RECEIVING CHILD SUPPORT. Child support calculation laws change March 28. The first change in 26 years. Wow! Going up or down? Depends. Different information than before is used to calculate. Examples: Day care has max limits. A parent gets 10% off support paid if he/she has the children over 90 overnights/year. Parents get a standard deduction for each child he/she has with another parent.The total health insurance a parent pays to cover self and the children is deducted, not just the extra cost to cover the children. Family Law attorneys will be very busy in the coming months consulting with parents on whether to return to court to recalculate support!
