"I'm moving. Can I take the kids?"
In California, the answer is not a simple yes or no.
A move-away case can depend on:
• whether there is already a permanent custody order
• whether physical custody is sole or joint
• what the parenting arrangement actually looks like
• the distance of the proposed move
• the child's relationships, age and stability
• whether a workable parenting schedule can continue
California law does not simply require a custodial parent to prove that moving is "necessary."
