Went to court for a client yesterday. The defendant said we had no case. So the defendant made no offer to settle. In fact they turned down a 35,000 demand As rediculous. So after presenting our facts and our case the judge awarded us 48.000. Trust point legal group practices the hieght of civility in all matters but when in court don't expect civility equals weakness Or lack of preparation. When Winning Counts.

Have you ever asked yourself what does I.Q. have to do with good parenting? Probably not and for good reason it has nothing to do with being a good parent. So my story starts.
Amy F’s I.Q. was found to be about 72, and Eric Ziegler’s was found to be about 66. So, the good State of Oregon took their sons. They were not taken because the children were abused or neglected but because mom and dad were not smart enough to have/or raise children. In the words of Children Protective Services (CPS) for the State of Oregon “the parents I.Q.’s was too low to be good parents.”
Case workers have found that Amy F (now age 31) and Eric Z (now age 38) are in fact competent parents. Regardless CPS in Bend Oregon claims that you cannot be good parents if you are what we call “re****ed” and “not having the intelligence to raise a child.”. This horrendous story doesn’t end here in fact the State of Oregon removed all four sons.
Four years ago and at, less than a week-old CPS took Christopher away. Why because he was abused, neglected or unloved no she is re****ed and we can’t allow woman like her to just go and have children. The States own investigation turned up neither abuse and nor neglect. Yet Christopher remains in the CPS foster care system and not home with his parents where he belongs.
This saga was repeated in February of 2017, Amy gave birth to their second son, Hunter. At only 2 days old, he was taken from the hospital and away from his loving parents by CPS. This time CPS did not waste any time they came right to the hospital and took Amy’s son. “it is better this way”
This newborn was denied the valuable colostrum of his mother for no other reason than CPS said mom was smart enough. Today, Hunter is also in foster care.
All this pain and suffering was visited upon Amy even though CPS’s case worker’s investigation found the couple to be good parents with no abuse or neglect present.

Just spent a week at the beach. Curtesy of my wonderful brother Mike and his wife Barbara. Sun, Swimming, reading (real books no ipad stuff) eating sea food, waking up late going to bed whenever.
So, what’s the point thanks Mike and Barb and more importantly, Monday I will be ready for bear.
That much rest and relaxation and you can build a lot of AT-TEE-TUDE. For a Lawyer this is a very good thing.

The Supreme Court of Pennsylvania recently expanded the law of Dragonetti to apply to lawyers who needlessly propagate litigation for their own purposes. It looks like our firm will champion one of the first cases of this type.

For 10 years an group of attorneys relentless pursued a husband and wife on behalf of their clients because the husband and wife spent too much money making a disabled woman’s last day comfortable and protecting her from the machinations of her own family to get at the money.

In open court the lawyer representing the family demanded $ 448,000.00 from the couple. 10 years of litigation and a three day the judge merely said there were a few unpaid bills the couple incurred getting expert help and unpaid taxes and it is they should pay them. As for everything else the attorneys and their clients get nothing.

But what about that couple, it is not cheap to keep attorneys on the payroll for ten years and so in light of this type of wear-them-down tactics the Supreme Court of Pennsylvania recently said "Responding to the matter as so framed, we decline to recognize generalized attorney immunity from the substantive principles of tort law embodied in the Dragonetti Act,"
