My opening statement on February 17, 2022, convinced the prosecutor to dismiss their case prior to calling any witnesses.

I tried to convince the prosecutor that he was wrong on the law and should dismiss before trial, but I guess the law finally clicked when he heard me explaining it to a jury of 6.

"Less than a month after the Silverman trial ended, the Oregon Legislature recommended a public vote to amend the state's constitution to allow 10-2 jury verdicts in most felony cases, said Clayton Tullos, a Eugene attorney and expert on the origins of Oregon's non-unanimous jury system.

Proponents of the amendment, known as Measure 302-03, cited the Silverman trial in the May 1934 Special Election voter pamphlet and newspapers in Eugene and Portland urged readers to support it. The amendment, which received no organized opposition, passed with 58 percent of the vote.

'It was a definite rush to judgment by an inflamed public' said Tullos, who published an article in 2014 on non-unanimous jury trials in The Oregon Defense Attorney journal. 'There wasn't much debate.'"

For decades, Oregon juries -- and those in only one other state, Louisiana -- have been permitted to convict most felony defendants with a 10-2 vote. A petition before the Supreme Court claims the statute deprives some defendants of equal protection under the law.

Not guilty jury verdict. Just before closing arguments the City Prosecutor had the arresting officer cite my client under a different theory for the same alleged crime. That citation became an exhibit in my closing argument as to why the City knew it lost this case.

The election is underway, vote Clayton Tullos for District Attorney of Lane County.

We need to become a leader in progressive criminal prosecution in our state in order to not only make our community a better place to live, but also to save money.

I have experience as a prosecutor, defender, and as a civil lawyer. Having a broad range of experience will help to bring balance to the prosecutors office.
