If you don’t have an incapacity plan, Oregon has one for you! It involves your family member seeking guardianship and conservatorship appointment through the court (on public record), paying attorney fees, court fees, court visitor fees and process server fees (probably all happening during a medical emergency or other stressful situation). These fees and costs add up extremely quickly! A power of attorney and advance directive and/or a trust can help avoid the need for guardianships and conservatorships by allowing you to appoint someone to make financial or medical decisions for you when you can’t speak for yourself. A complete estate plan should include comprehensive incapacity planning. Speak with a knowledgeable estate planning attorney to make an incapacity plan. Every adult should have one.

If you have a college-aged young adult, this estate planning message is for you. Your estate planning focus can now shift from nomination of a guardian for minor kids to making sure that money is appropriately managed for your young adult in the event of your death.
