A victory at the Oregon Court of Appeals this week.

Our client, a bus driver, suffered an occupational disease involving his upper back. After we prevailed before the Administrative Law Judge and again before the Workers' Compensation Board, the insurance company exercised its right to appeal to the Oregon Court of Appeals. This week, the Court affirmed our client's victory.

One thing people often don't realize is that injured workers don't just have to prove their case once. Insurance companies have the resources to continue litigating, appealing, and challenging favorable decisions. That's part of the process.

Our job is to make sure our clients aren't standing alone when that happens.

No matter how many levels a case goes through, we'll continue to fight for our clients and make sure their voices are heard. Justice shouldn't depend on who has the deepest pockets or tolerance for delay.

Another win for our client at the Oregon Workers’ Compensation Board

We recently prevailed in a case where an insurer resisted acceptance of an injured worker’s additional back condition for months after the treating physician formally requested acceptance.

Our client already had an accepted low back injury. The treating doctor then submitted written notice that the worker also had a disc herniation related to the job injury. Instead of timely accepting or denying that condition as required by law, the insurer delayed for over 200 days and later argued that the request did not count because the worker had not personally signed the form.

The Oregon Workers’ Compensation Board rejected that argument and affirmed that:

-A treating physician can formally initiate a new or omitted medical condition claim on behalf of an injured worker.
- Once the insurer receives that written request, the 60-day deadline to accept or deny begins and the insurer cannot ignore the request.

The Board affirmed penalties to paid to the client, attorney fees, and additional fees on review because the insurer had no legitimate basis to delay processing because the law established that a physician’s written request is enough.

Too often insurers resist acceptance of valid conditions by relying on technical arguments and delay. This decision is another reminder that deadlines matter and when insurers fail to follow the law, they can be held accountable.
