A stuck vehicle often leads to a DUI investigation in Oregon. We have represented clients that got stuck partially off the shoulder of Hwy 58, in the center median of I-5 and on railroad tracks in Eugene. However, we have never represented someone in a stuck Lamborghini as shown in this photo of Marcus Jordan's Tuesday morning DUI in Florida.

Looking over the Thai traffic laws and maximum penalties of 90 days jail and a 10,000 baht fine (about $275) for drunk driving seem very reasonable compared to Oregon’s 364 days max and $6,250 max fine for a misdemeanor DUI.

IID tip of the day: We've been hearing from some clients that their ignition interlock device (IID) is preventing them from starting the car even if they have not been drinking alcohol. These devices can be very sensitive and the use of alcohol based mouthwash, hand sanitizer and even garlic pizza have all resulted in false positives. Another common situation is drinking heavily the night before and getting up in the morning to drive not realizing that there is still alcohol in your system. If you get locked out by your IID but have not been drinking the best thing to do is rinse your mouth and blow into it again right away. If you blow into it within 10 minutes of a false positive and it registers 0.00% BAC then the failed blow will not count as an IID violation by statute. See ORS 813.599(4)(a).

Getting through an Oregon DUI diversion program which doesn't allow the use of alcohol or controlled substances without a prescription for a full year can be difficult. Many people use cannabis medicinally to treat certain ailments. One question I get all the time is can I use ma*****na while on DUI diversion? The good news is that in most cases if you have a valid OMMP card we can get an order from a judge allowing use of cannabis on diversion. In January of 2022 Oregon law was revised to make it easier to have your criminal record expunged. Prior to 2022 a person would need to have only a single conviction or a clean record for ten years to get their record expunged. New eligibility timelines are as follows:

• Class B Felony: 7 years
• Class C Felony: 5 years
• Class A Misdemeanor: 3 years
• Class B or C Misdemeanor: 1 year
• Violation or Contempt of Court: 1 year
