Black Marjieh & Sanford LLP is pleased to announce that Founding Partner Sheryl Sanford and Associate Nicholas Lamari recently secured dismissal of all claims asserted against the firm’s client, a homeless shelter that provided services to families in need.

The plaintiffs’ complaint stemmed from shelter and New York City Department of Homeless Services (DHS) procedures pertaining to fire drills and inspections of residents’ units. The plaintiffs claimed that the facility’s check-ins and fire drills were “discriminatory” and resulted in emotional distress.

In their pre-answer motion to dismiss, Sanford and Lamari argued that, as residents of a shelter operating under the auspices of DHS, the plaintiffs were required to exhaust all available administrative remedies before commencing the lawsuit. Sanford and Lamari also argued that the plaintiffs were using the complaint to file improper orders to show cause in an effort to bypass shelter rules. As stated in their moving papers, “plaintiffs should not be permitted to short-circuit and create precedent undermining the administrative processes and remedies available to them as this will only open the floodgates to more litigation.”

In close collaboration with the client’s legal team, Sanford and Lamari demonstrated that the facility was acting pursuant to safety protocols and regulations that the plaintiffs had specifically agreed to follow upon admission to the shelter. The Bronx County Supreme Court agreed, stating, “as shelter residents, plaintiffs are bound by the rights and responsibilities articulated in intake documents that they acknowledged and signed.” The Court subsequently granted the motion to dismiss in its entirety. Sanford and Lamari also successfully opposed the plaintiffs’ related order to show cause.

Black Marjieh & Sanford LLP is pleased to announce that Partner Sheryl Sanford and Associate Nicole J. Poccia recently secured dismissal of all claims asserted against the firm’s client, a recovery facility focused on serving community members struggling with addiction.

Plaintiff’s complaint stemmed from her former partner’s involvement with “sex and/or love addiction” meetings hosted by the recovery facility. Plaintiff claimed that the facility’s materials and representations regarding “sex and/or love addiction” were deceptive and medically unrecognized, allegedly causing plaintiff’s former partner to break up with her. As a result, plaintiff claimed she suffered severe emotional trauma.

Sheryl Sanford and Nicole J. Poccia moved to dismiss the action in its entirety pursuant to CPLR § 3211 on the grounds that plaintiff lacked standing and “is attempting to blame an organization whose goal is to help people, for the private and independent decisions of her former partner.” They further argued that the defendant owed no duty to the plaintiff and did not injure the plaintiff in such a way as to warrant relief. The Court agreed and granted the motion to dismiss in its entirety.

Black Marjieh & Sanford LLP is pleased to announce that Partner James J. Lofrese recently secured summary judgment dismissal of all claims asserted against the firm’s client, an adult day care rehabilitation facility serving members with cognitive impairments and brain injuries.

The plaintiff, a member of the day care program with dementia-related cognitive issues, tripped and fell on an exterior walkway leading to the facility’s entrance. The plaintiff, who was nonverbal, did not testify. The only eyewitness testified that she had turned her back momentarily, and by the time she turned back around, the plaintiff was already in the process of tripping over and across a low retaining wall separating the walkway from a lower patio area.

The plaintiff’s attorneys argued that the low retaining wall created optical confusion and otherwise rendered the premises unreasonably dangerous. Mr. Lofrese’s motion focused on the fact that the witness did not see the plaintiff’s foot strike the wall and could not identify what caused the plaintiff to fall, making it speculative to assume that the retaining wall caused the accident rather than the plaintiff simply losing balance for some other reason.

Mr. Lofrese also submitted the report of a professional engineer who concluded that the walkway and retaining wall complied with all applicable building code regulations and did not otherwise constitute an unreasonably dangerous premises condition. In its decision, the Court dismissed all claims against the day care facility and its employees, as well as against the premises owners.
