A word on Continuances. Sometimes a potential client will call me and say "I want to retain you on my Driving Without a License case. My trial date is next week, so I am going to get a continuance and then retain you." Please understand this: you, the Defendant, cannot continue your case. You can't do much of anything without a lawyer. You can ASK a Judge to continue your case, but often the Judge will say NO. And then you get to represent yourself, and quite likely lose your driver's license and perhaps go to jail on the spot. So retain a lawyer FIRST and DON'T think you can "get a continuance, 'cause this is the first trial date, see. . .. " That is not how things work in court. People are forced to represent themselves all the time, and trying to be your own lawyer usually doesn't work out well, at all.

Happy Holidays! If you get pulled over after a few too many Christmas Spirits this season (and trust me, a lot of people will) remember you have the Right To Refuse To Perform Field Sobriety Tests. I put this in all caps because it is very, very important. When an officer asks you stand on one foot in freezing windy weather on the side of the road in the middle of the night JUST SAY NO. You are NOT going to do well on these tests (walk an imaginary line on icy asphalt at 2:00 a.m., and then pivot on your heels, follow my pen with your eyeballs. . .) People take these idiotic, designed-to-fail "field sobriety tests" all the time, do miserably, and then come into my law office with their tale of woe. Ho Ho Ho JUST SAY NO TO THE FIELD SOBRIETY TESTS.

The weeks after Memorial Day are prime-time DUI days. Lots, and lots, and LOTS of people are getting pulled over, some folks literally get two DUI's in two weeks during the summer months. If you are arrested for DUI, in most cases the police will seize your Driver's License on the spot, and give you a piece of paper to serve as a Temporary Driver's license. If that happens to you or someone you know--and this summer, it very may well happen to you or an acquaintance of yours--CALL ME immediately. You can lose your driving privilege for 6m-1Y even if you go to court and are found Not Guilty of DUI. And, if you are stopped driving on an alcohol-related Suspended License, you are probably going to jail. So call me first, and I will explain how the MVA, the Office of Administrative Hearings, and District Court--three separate and unrelated entities, with separate judges and hearings--all operate when a person is charged with DUI. 443 825 6368

If you are charged with a relatively minor traffic offense that carries the possibility of jail time DO NOT try and represent yourself. I watched a man get sentenced to 20 days in jail for driving without a license in the District Court for Baltimore County located in Catonsville this morning. He is in jail as I write this. His license expired, he didn't renew it, and now he is behind bars--because he didn't bother to retain a lawyer and showed up for court by himself.
