Most people walk into a divorce not knowing what they don't know.

And that gap in knowledge costs them, sometimes financially, sometimes in their relationship with their children, and sometimes in ways they don't realize until years later.

After 25 years of guiding California families through divorce, these are the 5 mistakes I see most often:

• Letting emotions drive important decisions. Divorce brings out the strongest feelings. But the decisions you make in the middle of those feelings shape your family's future for years. Give yourself space to feel, then let strategy lead.

• Putting children in the middle. Using children as messengers or sounding boards causes lasting emotional damage. It also signals poor co-parenting judgment to a family court judge. Keep your children out of adult conflict completely.

• Oversharing on social media. Everything you post during a divorce becomes potential evidence. One photo, one caption, one comment can raise serious questions about your judgment in front of a judge. Think carefully before you post anything.

• Focusing on winning instead of resolving. The goal is not to beat the other party. The goal is to reach agreements that your family can actually live with for years to come. Prioritize long-term stability over short-term victories.

• Assuming court is the only option. It is not. Mediation and collaborative divorce give California families a faster, less expensive, and far less damaging path to resolution. Most families never need to set foot in a courtroom.

Swipe through our carousel for a deeper look at each of these mistakes and what to do instead. Your family deserves better than a courtroom battle. We are here to help you find a better way forward.

Did you know that in a collaborative divorce both spouses have their own attorney present throughout the entire process?

Most people are surprised when they hear this.Collaborative divorce does not mean sharing one attorney or figuring things out on your own. Both parties sit at the table with their own fully trained collaborative divorce attorney, working together toward a resolution that serves the whole family.

Here is what that looks like:
• Both parties have their own legal advocate protecting their interests
• Neither spouse feels unrepresented or vulnerable at any stage
• Both attorneys work together, not against each other
• The process stays completely out of the courtroom
• Every agreement reflects what both parties genuinely chose

This is one of the most powerful differences between collaborative divorce and mediation. And it is why so many California families choose it.

Most people who walk through our doors don't come in feeling strong.

They come in exhausted. Scared. Convinced that choosing themselves means losing everything.

But here is what we have watched happen over and over again in 25 years of helping California families.

The people who find the courage to make this decision almost always say the same thing on the other side.

"I forgot what it felt like to just be me."

Not the version that kept quiet to avoid conflict. Not the version that smiled through things that hurt. Just me.

Divorce is hard. We will never pretend otherwise. But how you go through it changes everything. The right support, less conflict, and a process that protects your peace gets you to the other side faster and with more of yourself intact.

Your next chapter is waiting.

You don't have to figure this out alone. We are here.

Did you know that California courts can order both parents to attend co-parenting classes?

Co-parenting after divorce requires both parents to communicate, cooperate, and put their children first, sometimes for decades. Most parents walk into that reality completely unprepared.

Co-parenting classes equip both parents with tools to:
• Communicate without conflict spiraling
• Keep children out of adult disagreements
• Support their child's bond with the other parent
• Handle transitions calmly and consistently

The parents who take this seriously raise more secure, happier children.

Do not wait for a judge to order it. Reach out today, and let's talk about building a stronger co-parenting foundation for your family.

Some of the most important decisions a family makes happen during divorce. How those decisions are made matters.

Here are 5 advantages of Collaborative Divorce:

• More Privacy
Discussions take place outside of a public courtroom.

• More Control
Families help shape the outcome instead of leaving decisions to a judge.

• Less Conflict
The process encourages respectful communication and problem-solving.

• Child-Focused Decisions
The needs and well-being of children remain a top priority.

• A Better Foundation for the Future
Collaborative Divorce can help preserve relationships and support healthier co-parenting moving forward.

That photo from two years ago? In a custody case, it's fair game.

Social media appears in over 80% of California divorce and custody proceedings. One post, one photo, one comment can raise serious questions about your parenting in front of a judge.

Our rule for every client: before you post, ask yourself if you'd want a judge to see it. If the answer is no, don't post it.

We protect our clients before cases get derailed. Reach out today, and let's talk through where you stand.

Can you write your own prenup in California?

Yes, California law does allow you to draft your own prenuptial agreement and have it notarized without an attorney. But before you go the DIY route, here is what you need to know.

Without proper legal knowledge, self-drafted prenups often:
❌ Omit important information required by California law
❌ Include errors or invalid language
❌ Miss critical legal requirements specific to California
❌ Get thrown out entirely by a court when you need them most

A prenup that doesn't hold up in court offers zero protection.

That is why we always recommend working with an experienced California family law attorney who understands exactly what your agreement needs to include to be legally valid and enforceable.

At Shearer Law and Mediation, we help clients draft prenuptial agreements that are comprehensive, legally correct, and fully compliant with California law so you can walk into your marriage with clarity and confidence.
