No. Attorney Dan Matrafajlo explains what the term actually covers, and it is narrower than people assume.

New Jersey's no fault law says nothing about who caused the collision. It answers one question only: who pays the medical bills.

The answer is your own side first. Your PIP carrier under your auto policy is primarily responsible, and your health insurance sits behind it unless you elected health as primary.

That is the whole of it. Fault for causing the crash is a separate question with separate consequences.

1 deer, 1 crash, and nobody at fault. So who pays?

There is no other driver who did anything wrong. No one ran a light, no one was texting, no one was following too closely. A deer came out of nowhere.

In the practice of law that is an act of God. There is no negligence claim to bring, because there is no negligent person to bring it against.

It is one of the few crashes where the honest answer is that nobody is at fault.

What actually happens after you report a fall on a commercial property?

It opens with preservation. The exact hazard gets identified, witnesses located, incident reports secured, and letters go out for surveillance video, cleaning logs, repair records and insurance information.

Then the file narrows to four questions. Was there a dangerous condition. Should the owner have discovered it. Did that condition cause the injury. Do the medical records establish real damages.

If the proof holds, a demand goes to the carrier. If the carrier stonewalls, the matter moves to suit, discovery and depositions.

Ed expected the worst. He was doing double the speed limit.

That was the Rahway ticket. In his own words: “Dan T. Matrafajlo, with help from Chris Edouard, got the entire case dismissed.”

Then a second one, in Woodbridge. Alyssa Inghilleri took that one and had it brought down to an unsafe driving charge with no points.

$225,000 was the judgment. The injuries decided that number, not the dog.

Here is what people miss about dog bite claims in New Jersey: proving the owner is responsible is the easy half. The statute already does most of that work.

A wet floor is not a case. A wet floor nobody checked is.

This is the part of New Jersey premises law that surprises people. Falling on a hazard is not enough on its own. You generally have to show the owner knew, or should have known, and had a reasonable chance to fix it.

Lawyers call that notice. It is why the sweep log and the timestamp on the security footage often matter more than the injury photos.
