We were successful in a stipulated trial in Jersey County for a very nice client who was charged with trespass after she went to her neighbor's to retrieve a delivery that was dropped off at the wrong address. She and the neighbor had a property dispute that had caused bad feelings between them. The neighbor did not post a No Trespassing sign at the entryway to the property, although he did allegedly have a small sign closer to his residence. She did not see the small sign. We had the client photograph the exterior from the public way and we submitted all to the court for its consideration. The judge ruled the state could not prove that element of its case against her and she was found not guilty.
We also helped two other clients avoid mandatory jail time (and felony DUI enhancements) on their DUI charges in Jersey County. Both had multiple prior DUI charges.
In Macoupin County we negotiated a DUI suspension rescission for a client who had a CDL license that he required during harvest season on his family farm.
We won a motion to suppress evidence for a client who was charged with Agg. Unlawful Use of a Weapon. The state dismissed the charge this week. He was facing a conviction if we did not win the motion hearing. Needless to say he was very pleased with the outcome.

We were able to negotiate a plea to second degree murder (4-20 years at 50% or probation) from first degree murder with a firearm enhancement (45-75 years at 100%). The facts presented a good self defense argument. The plea was "open" meaning there is no agreed to sentence. The court will set the sentence after a future hearing. We do have quite a bit of mitigating evidence. I will request probation be imposed. The state will request 20 years be imposed. The client shot a person who he believed to be reaching for a firearm one time, killing him. The victim in the case was intoxicated (.16 BAC), had thrown two women down inside a bar before attacking my client. He had also taken his shirt off in side the bar before attacking my client. The victim did not have a firearm but he did act as if he did.

Another client won his felony Agg. Unlawful Use of a Weapon after we filed a motion to suppress. The case involved a client who crashed a car exited with a firearm and returned without a firearm. A witness told his version of events to the police when they arrived on scene. My client was arrest but not Mirandized. The police questioned him and he admitted he threw a firearm on top of a building after the crash. The gun was recovered and he was charged with the felony. The issue would seem fairly straightforward as he was not Mirandized any statement evidence (or other evidence resulting from his statements) should be suppressed. However, there is an exemption to the Miranda warning when a public danger exists. The state argued the public danger existed, and the court agreed. However, we argued that despite a danger existing my client invoked his right to counsel prior to questioning and the police ignored his request. The Court seemed hesitant to agree with us and grant the motion. Hannah briefed the issue. The court agreed with us and the client got his case dismissed and was very happy.

Hannah won a mandatory prison time felony (felon in possession of a weapon) case Tuesday in St. Clair County. We filed a motion to suppress the evidence after the feds searched my client's residence and located a firearm in his bedroom. There were spent casings outside of the residence by the bedroom window. The agents were searching for another person who was wanted on a murder arrest warrant. The problem was that the wanted suspect had no connections to my client or the residence. The motion alleged a fourth amendment violation of my client's rights. Hannah prepped the clients family for testimony and the State made the call to dismiss all charges just as the motion hearing was set to begin. My client will serve zero time in custody for this offense and the charge is now dismissed. He was very happy with the outcome.

We were able to obtain DUI dismissals for two clients in Macoupin County.

We also obtained a suspension rescission for another client in Macoupin County last week.

We were prepping for a first degree murder trial set to begin June 8, 2026. The state has now offered a second degree murder plea. This will be an important decision my client must now make as second degree has far less sentencing implications than first degree. We do have a strong self-defense theory to the case.
