This article is from 2010. Sadly, not only has nothing improved, but in some ways, it's even worse because the banks have learned there is virtually no accountability or consequences for fraud.

This quote is one reason I get so angry - because it is so on point: "Now, one might think that after a bank makes multiple attempts to push phony documents through a courtroom, a judge might be pi**ed off enough to simply rule against that plaintiff for good. As I witness in court all morning, the defense never gets more than one chance to screw up. But the banks get to keep filing their foreclosures over and over again, no matter how atrocious and deceitful their paperwork is."

We must flood our state representatives with demands that this stop. If you can't tell the truth, the whole truth, and nothing but the truth and win, then you don't get to win even when that means a homeowner wins over the bank.

How foreclosure courts are helping big banks screw over homeowners

This will premiere on August 5 for free. This is not something we can brush off as "in the past" because it is still happening. I still have clients in danger of losing their home even though they were not in default. I have clients who have suffered immensely due to their mortgage servicer's actions when they (my clients, not the servicers) were trying to do the right thing. I am constantly amazed at the number of shrugged shoulders I get when I bring these things up in court, to opposing counsel, and to people who have never had a problem with money or their mortgage.

Dragging someone through hell for many years for no reason is not okay. This. has. to. stop.

EVICTION NOTICE UPDATE

We know that this will be difficult, but want to give as much notice as possible regarding OCSO deputies serving eviction notices.

Deputies will start serving judicial eviction orders this week, and enforcing evictions on May 26, 2020.

We understand how tough times are currently for many as a result of the health crisis the past few months, but we must enforce orders issued by the courts. Once the order is served tenants have 48-hours to leave the premises of the residence they are renting/leasing.

Please, if you are set for an eviction hearing, attend. Make your case to the judge, the only person who can determine your case.

Civil process, and our issuing evictions is mandated by state law:

We will be compassionate, and respectful during scheduled evictions. We are hopeful that everyone issued an eviction will be able to make living arrangements.

Here is some good information. Remember to keep detailed notes of all phone calls and correspondences with your mortgage servicer. If your servicer refuses to work with you or makes demands such as requiring payment in a lump sum of any forbearance at the end of the forbearance, you may consider contacting a consumer rights attorney to help you navigate the process.

Homeowners who have received mortgage forbearance need to weigh options carefully to ensure that they’re not just kicking the can down the road.

This article has more information regarding stimulus payments that people may be receiving. I don't know how Oklahoma is treating the payments, but I'm not a fan of allowing debt collectors to go after funds that are intended for you to be able to pay your (immediately due) bills and provide for your family.

‘Millions of Americans have court judgments against them,’ says Lauren Saunders, an associate director at the National Consumer Law Center.

Rob Allen and his friends used to talk about sports all the time. These days, the main topic of conversation is mortgage forbearance.
