Your job is to tell me about your family, what you have built, and what you care about. From there I will educate you on your options and we will build something together. Probate court is where a will goes to be processed after someone passes away. It is public, it is slow, and it can get expensive. I build plans designed to keep your estate out of that process entirely by using tools like a revocable living trust that passes assets directly to your loved ones without any court involvement. The will is still part of the plan but it is the backup, not the vehicle.

I want to say something directly to the parents sending kids to college this month. You have spent 18 years taking care of them and now they are headed out on their own. Before they go, sit down with them and talk about getting a couple of basic legal documents in place. It is a short conversation and I can make the process simple. It is one of the most practical things you can do before drop-off day.

If you have a college student heading out this fall, here is something most parents do not know. Once your child turns 18, you no longer have automatic legal authority to make medical or financial decisions for them. If your student is in an accident and cannot communicate, the hospital is not required to tell you anything or follow your wishes. A healthcare directive and a financial power of attorney for your young adult child can change that. I can help you get those documents in place before move-in day.

A lot of people think they can skip the estate planning conversation because they are young and healthy. I understand that logic, but I want to offer a different way to think about it. The best time to build your estate plan is when you are young and healthy and have plenty of time to be thoughtful about it. The worst time is when something has already happened. Here is something to think about this week. If something happened to you today and you became incapacitated, who would step in to manage your financial life? Who would have the legal authority to pay your mortgage, handle your bank accounts, and make decisions on your behalf? If the answer is not clear and documented, your family could end up in court trying to get that authority in the middle of an already difficult time. I can help you fix that.
