Three trials this week. First was an 11 point speed. We lost but decision is highly questionable and should be appealed. Officer can’t testify as to calibration simply because the department told him do and they didn’t offer department records. Also, you cannot establish a “steady pace” of a vehicle when you are traveling at 95 mph and the pace was a total of 100 yards. That’s less than a pace of 3 seconds.

The second case was a speed that wasn’t questionable but the cellphone was and I convinced the judge to dismiss the 5 point cellphone (d), which had been our goal from the beginning.

Lastly, we held a teams video conference trial where it was alleged that my client had committed a serious family offense. At the close of the plaintiff’s case I made a motion to dismiss the petition as it failed to establish the necessary elements required.

Overall not a bad week.
