The Office of the Chief Administrative Hearing Officer (OCAHO) published a precedent decision in Temitope Ogunrinu v. Law Resources & Arnold & Porter, 13 OCAHO no. 1332h (2020). In a case arising under the anti-discrimination provisions of 8 U.S.C. § 1324b, Complainant and both Respondents filed motions to compel discovery. As to Complainant’s motions to compel discovery from the Respondents, the Administrative Law Judge (ALJ) sustained some of Respondents’ objections to the discovery requests, but overruled others and ordered Respondents to respond to the requests in whole or in part. Regarding Respondent Law Resources’ motion to compel, the ALJ found that Complainant failed to comply with previous orders requiring responses to the requests. Complainant was ordered to produce the missing information, and the ALJ found that Complainant was subject to discovery sanctions based on her conduct. As to Respondent Arnold & Porter’s motion to compel, the ALJ compelled Complainant to supplement her discovery. Further, the ALJ found that Complainant did not timely respond to Arnold & Porter’s requests for admission, so the requests were deemed admitted. Finally, the ALJ denied Complainant’s request for additional time to file an expert report regarding damages because Complainant did not show good cause for additional time and did not show how an expert would help establish damages. The ALJ also denied the request as a sanction for failing to comply with the ALJ’s previous order requiring Complainant to provide a computation of her damages.
