This can be a complicated concept for a lot of people. When a jury is selected, the citizen-accused is not protected by our double-jeopardy concept until and unless the jurors all raise their hands and take their oath. That is why the prosecutor in this case was allowed to dismiss - temporarily - and re-issue the case almost immediately.

From a practical standpoint, the problem here is that the accused and his/her attorney already invested resources and time into preparing for a trial that did not occur. Horrible. You might say "well this person did a really bad thing and too bad so sad" - except what if this person is not guilty? Or, not guilty of the crime charged?

The attorney in this case sells her time for a living; not a result; not a will or a contract but her time doing one of the most stressful things on the planet: defending a person charged with a horrific crime.

So, I understand the attorney's frustration and I empathize 100% - I have had this very thing happen. I empathize with the frustration of the client/accused.

At least the prosecutor - according to this article -- re-authorized the charge almost immediately so that a bunch of time did not pass -- thus fading the lawyer's institutional memory of the story as told by the evidence.

Yes - the elephant in the room is what the witness was concerned about vis a vis the 5th Amendment. I hope that the media keeps following this because, as they say "enquiring minds (or is it "inquiring"?) want to know.
