As an attorney handling automobile injury cases, I have noted with greater frequency that insurance companies seem to be pushing a minimal limit for insured's Personal Injury Protection (PIP)! Many people have only $15,000.00 or less in PIP coverage. This means that if you are injured in a car accident, your insurance company will only pay up to $15,000.00 of medical bills. In this day and age of chiropractic, pain management, MRI's and other forms of treatment and diagnostic testing, $15,000.00 does not go very far! IMPORTANT DWI INFO: If you were convicted of a DWI in the past few years, there is a chance that you may be able to have your conviction overturned, The New Jersey Supreme Court recently ruled that over 20,000 cases may need to be retried, as a result of a State Police technician's errors in calibrating Alcotest devices, and thus rendering the Alcotest results as being unreliable. This does not apply to every case, but only those which involved the improper calibrations. If you think you may have been wrongly convicted, please contact my office.

DID YOU KNOW that if you lose your license for DWI and then have two convictions for Driving While Suspended pursuant to that DWI, you face MANDATORY JAIL TIME of 180 days. No plea bargain! Same applies if you have a second DWI and then a first Driving While Suspended pursuant to that second DWI. Please don't drink and drive!

IMPORTANT AUTO INSURANCE NOTE: One of the most important (and overlooked) provisions of your auto insurance is the Uninsured/Underinsured (UM/UIM) coverage. While we often make sure that we have sufficient liability coverage in the event that we are sued, it is also important to have sufficient UM/UIM coverage. This will protect you if you suffer significant injuries in an accident and the at-fault driver has minimal liability protection or no liability coverage at all. You can then make a claim against your own insurance company for the value of your injuries up to the amount of your coverage. You can only have UM/UIM coverage up to the same limits as your liability coverage. But the UM/UIM coverage should NEVER be less than the liability. The cost is extremely minimal and will give you far greater chance to recover what you may be entitled to. If you have any questions, please call for a free consult !

NEW LAWS: Two new laws of interest were enacted in November of this year. NJS 33:1-2(f) forbids the Use or Possession of Powdered Alcohol while NJS 4:22-17(c)(4) now prohibits be******ty! Elsie the Cow is safe at last ! LOL !

BEWARE OF NEW CASE INVOLVING LEAVING THE SCENE OF AN ACCIDENT: The New Jersey Appellate Division ruled today in the case of State v. Sene, that a person can be convicted of Leaving the Scene of an Accident, under both the criminal and motor vehicle laws EVEN IF THERE IS NO CONTACT between the Defendant driver and the accident victim! Drivers beware!

NEW DRUNK DRIVING LAW VETOED BY GOVERNOR CHRISTIE: Many people who come to me with a DWI charge ask if there is any way they could just drive to work. The answer for many years has been "No". However, the New Jersey Legislature, with the approval of Mothers Against Drunk Driving (MADD), passed legislation allowing First-Time Offenders only the opportunity to continue driving, provided that they install an interlock device in their vehicle, which they must blow into prior to starting the car to ensure they are not intoxicated. The bill went to the Governor's desk, and he promptly vetoed the bill. So, if convicted for DWI, no driving anywhere until the suspension has run.
