This is our annual holiday post: Whether or not you get along with your children's other parent, the holiday season is for your kids. Please figure out a way to ensure that it is enjoyable for them. If your custody order says you have Christmas in odd years- this is your year. If it says even years- this is not your year. Let's make this Christmas as drama free for your kids as possible. You can go back to fighting in January!

We wish everyone a joyous and safe Thanksgiving! Our offices will be closed 11/27 - 11/29 to celebrate.
Please check your custody orders (this is an even year) and try to get along with everyone at the family gatherings because the court is closed until Monday and you would hate to spend the weekend in jail!

As a reminder, it is important to remember that the holidays are a time for your children to enjoy. Put aside the differences you have with your ex so that your children will have an enjoyable holiday! Increased drama may reduce the funds you have to help your children celebrate since you may have to pay your attorney to fix it!

As the holidays approach, here is your annual reminder:
1. Check your custody order....this is an odd year, so if you have Thanksgiving in odd years, this is your year. If you have Christmas in odd years, this is your year. If you have even years for either holiday, this is not your year.Please follow the instructions.
2. Keep the holiday season about the kids. Just because you don't like the other parent, don't penalize your children.
3. Keep in mind that courts, attorneys and other legal staff have scattered vacation and closure dates during the holiday season. If court is closed, there is not anything your attorney can do to make it open. If your attorney's office is closed and they still choose to return or answer your call, expect to pay a premium because they need vacation too!

Please govern yourselves accordingly.

Helpful hints this Thanksgiving for those who have a parenting agreement/custody order:

Step 1: Find your parenting agreement/custody order
Step 2: Find the section labeled "Holidays" or "Thanksgiving"
Step 3: Identify what counts as "Thanksgiving".
Step 4: Review what your parenting time is to be for the Thanksgiving period (2021 is an odd year, in case you have that type of breakdown)
Step 5: Follow your agreement/order!

Keep in mind that your attorney will likely be taking time off for Thanksgiving either starting Wed or Thursday. If they have to take your call during the holiday, you will pay more. Also keep in mind that the courthouse is closed for the holiday on Thursday and Friday, so it's not like you can "leap" in front of your judge immediately if there is an issue. Finally, remember, it's all about your children! They have had a lot to deal with in the past 18 months outside of what may be going on in your family. Make it the best Thanksgiving it can be for them!

If you live in Durham or Mecklenburg counties or other places where "stay in place" orders have been issued, read the order carefully because you are allowed to travel to the custody exchange location. These orders do not relieve you of the duty to follow your court order!

PSA- The Coronavirus does not cancel your existing court order. Unless there is agreement, please make sure that you follow the custody exchanges as outlined. While the courts are not handling most matters right now, they are handling emergency matters. Don't push it!

PSA - As we are entering the holiday season, this is a good time to review your existing custody order. Please don't disrupt your children's peace by allowing a dispute with their other parent to create conflict this holiday season. To help you as you review the order - this is 2019 so it is an odd year. Thanksgiving is November 28 this year. Christmas and New Year's day are both on Wednesdays. For your children's sake - please allow this holiday season to feature peace on earth and good will to all men.

PSA- As we are in the midst of the holiday season, this is a great time to review your current custody order/agreement. Make sure you know when you are supposed to have parenting time with your child/ren. This is an even year, if your order/agreement has an odd/even split. Please do all you can to make sure the holidays are good for your children, even if you don't get along with the other parent. Also remember that your attorney likely will be taking some time off and the courts will be closed for some of the time, so it may be difficult to get resolution through the courts if there is an issue. Let's aim for some peace during this holiday season, it will truly benefit your children and keep a little more money in your pockets.
