What happens when the tenant does not leave after the lease ends? If the lease term has ended, the lease has not been renewed, and the tenant remains in possession without the Landlord's consent the tenant is now a holdover tenant. An eviction action would be required to legally remove the tenant from the premises.

I often get the question..."how do I recover the unpaid rent?" If filing an eviction action the Landlord may make a claim for possession of the property and damages/unpaid rent. Sometimes an eviction action is not necessary and the Landlord may then file a small claims action for the unpaid rent. Recovery of the rent may require additional steps after a final judgment.
