My tenant stopped paying rent" "Can I shut off the utilities?"
The answer is NO. Section 83.67 of the Landlord Tenant Act states "a landlord of any dwelling shall not cause, directly or indirectly, the termination or interruption of any utility service, including but not limited to water, heat, light, electricity, gas, elevator, garbage collection, or refrigeration, whether or not the service is under control of, or payment is made, by the Landlord. A Landlord that violates this section may be liable for actual and consequential damages or 3 months' rent, costs, and attorney's fees.

What happens when the tenant does not leave after the lease ends? If the lease term has ended, the lease has not been renewed, and the tenant remains in possession without the Landlord's consent the tenant is now a holdover tenant. An eviction action would be required to legally remove the tenant from the premises.

I often get the question..."how do I recover the unpaid rent?" If filing an eviction action the Landlord may make a claim for possession of the property and damages/unpaid rent. Sometimes an eviction action is not necessary and the Landlord may then file a small claims action for the unpaid rent. Recovery of the rent may require additional steps after a final judgment. How to handle a tenant that has stopped paying rent? The first step is to provide a 3 day notice.
