Record as much information about the officer as possible, the name of their supervisor/ sergeant/ division/ area office/ badge number, car license plate etc, as well as the date/time and location of any interaction, any case number or unique information regarding a warrant or paperwork.

• Stay calm. Don't run. Don't argue, resist or obstruct the police, even if you are innocent or police are violating your rights. Keep your hands where police can see them.

• Ask if you are free to leave. If the officer says yes, calmly and silently walk or drive away. If you are under arrest, you have a right to know why.

• You have the right to remain silent and cannot be punished for refusing to answer questions. If you wish to remain silent, tell the officer out loud.

•Do not consent to any search, attempt to record the interaction with your phone if you can do so safely without presenting a perceived threat to the officer, most Virginia State Police and other state law enforcement agencies do not wear body worn cameras.
Most vehicles will have cameras that record (usually)when emergency lights are activated, officers may wear a connected wireless microphone.

Even if the officer is nice, an acquaintance or friend, they may likely be under duress for threat of loss of their career or even being charged criminally if they refuse to enforce new laws. Remember its possible everything you say is recorded and will be reviewed by other members of the agency. It is critical to sever any and all pre-existing trust and assume anything said will be used to build a case against you by the Commonwealth.

•If property is seized or taken demand a receipt that details all items taken

Anything and everything you say will be used against you, even idle comments, opinions, or reasons why you choose to not answer any questions. Ensure everyone with you or around you remain silent. Do not claim possession of a firearm or accessories until you consult an attorney. Be weary that state law enforcement may claim information that is not true in an effort to persuade you to provide condemning testimony.

This past Tuesday evening, while waiting for students to arrive at the fire department for a class, one of the students arrived and I asked about his mother's condition. He updated me on the situation, and I began inquiring about the details, learning that they lacked an attorney and essential documents. He mentioned that the process would be costly. A reminder Power of Attorney is arguably more important than a will, and more urgent.

Just had a call on from an older lady asking about moving bills into her name from her husbands, who she's caring for as he has early stage dementia.

Yet she hadn't yet done Power of Attorney. This is by far the more urgent consideration. Get it done while someone has the capacity to sign it. Then if and when they lose their faculties, the transition so you can look after their finances (and health and welfare) for them is relatively easy.

If not, leave it too late, and the money may be locked away unless you got to the Court of Protection which is often and expensive and time consuming nightmare.

Better still get a PoA when young. I did mine before I was 40. It is in place, so that if I lose my faculties in the future at that point (not before) someone can take over.
