About 6 months ago I made it public that I was leaving my awesome job and transitioning to my own personal injury firm, JB Legal. It has been a wild ride so far. I'm still getting the hang of business promotion, but I will promise one thing: I will always fight to get my clients a fair settlement that they understand and choose to accept. And if we can't a fair number from the insurance company, then I am always willing to go all the way to trial. Hey to all of you parents telling your kids that you are going to call Santa and tell him they are being naughty:

The elements of civil "Fraud" in Utah are
1: The Defendant made a false statement about an important fact; and
2: Either the Defendant made the statement knowing it was false, or he made the statement recklessly and without regard for its truth
3: The defendant intended that the Plaintiff would rely on the statement; and
4: The Plaintiff reasonably relied on the statement; and
5: the Plaintiff suffered damages as a result of relying on the statement.

Ya'll a bunch of fraudsters.

I often get asked whether I'm a "bulldog" as an attorney. I get what they are asking, but I don't really think that breed of dog is a good descriptor. What breed of dog would describe the type of attorney you would want representing you? (Side note, most of the time, a "bull dog" attorney will just cost you more money or time).

Did you know that in Utah, almost every automobile insurance policy carries a $3,000 personal protection policy (PIP) that covers the first $3,000 in medical bills after a car accident, regardless of who is at fault? This policy can be used to visits to a chiropractor, primary care physician, instacare, physical therapist or hospital. Sometimes you can even use it for massage therapy, depending on the provider. There are some commentators online who are suggesting that misogyny was a significant factor in the Presidential election last week. It's hard to tell how much something like that comes into play, since people often keep those prejudices private. President Trump carried the state of Arizona, but republican senator Kari Lake lost by close to the same margin that VP Harris lost by. Trump won Wisconsin, but Dem candidate Tammy Baldwin won the Senate seat. Trump won Michigan, but Dem candidate Elissa Slotkin took the senate seat. Trump won Nevada, but Dem candidate Jacky Rosen won the senate seat.
