PSA: Don't buy real estate without purchasing an Owner's Policy of Title Insurance.

I just got off the phone with a woman seeking some help. She purchased land with cash in 2019. She didn't buy an Owner's Policy of Title Insurance because, according to her, "the land was in her family for years."

She recently began building on the land (foundation poured, well dug) in anticipation of taking out a loan against the property to finance the remainder of construction. She was due to close on the loan this week when her lender's attorney told her that there was a title issue that originated almost 40 years ago (well before her purchase) and the property is currently unmarketable and uninsurable. She is now forced to halt construction and head to land court on a Petition to Quiet Title.
