The passing of Dolly Parton is incredibly sad. ❤️

But as an estate planning attorney, it also made me think about the incredible legacy she created long before her death.

Dolly didn’t simply accumulate wealth. She used it.

Her Imagination Library put hundreds of millions of books into the hands of children. She supported education, healthcare, disaster relief and her Tennessee community. She gave while she was alive and was able to see the impact of that generosity.

Now comes an interesting estate-planning question:

Who will inherit Dolly Parton’s estate?

With her husband having predeceased her and no children, will her estate benefit siblings, nieces and nephews? Will trusts be involved? How will her music and royalty rights be handled? And could the Dollywood Foundation, Imagination Library or other charitable causes ultimately receive a significant portion?

We don’t know yet—and until actual estate documents or court filings provide answers, guesses about her beneficiaries are just that: guesses.

But Dolly’s story provides a wonderful lesson for the rest of us.

You don’t need Dolly Parton’s fortune to think about your own legacy.

Maybe there’s a charity you love. A school that changed your life. An animal rescue. A religious organization. A scholarship you’d like to create. Or maybe you simply want to make sure the people you love are protected.

A good estate plan answers “Who gets my property?”

A great estate plan also asks, “What do I want my legacy to be?”

I explore Dolly’s charitable history, the fascinating questions surrounding her estate and what the rest of us can learn from the way she lived and gave.

💰 What if you could leave your children an inheritance they can control—without giving up many of the protections of a trust?

That is the idea behind a Beneficiary-Controlled Trust.

Instead of leaving an inheritance outright, an Arizona estate plan can allow assets to remain in a trust for your child’s lifetime. Depending on how the trust is structured, your child may be able to:

🔹 Serve as trustee
🔹 Control investment decisions
🔹 Access funds for health, education, maintenance and support
🔹 Benefit from creditor and lawsuit protection
🔹 Better preserve inherited assets in the event of divorce
🔹 Decide who receives remaining assets through a limited power of appointment
🔹 Keep wealth protected for children and future generations

The point isn't to control your children from beyond the grave.

It's to give them control without unnecessarily giving up protection.

For Arizona families, a Beneficiary-Controlled Trust can offer an appealing combination of control, access and asset protection—and may be worth considering before simply directing that an inheritance be distributed outright.

Read more about how Beneficiary-Controlled Trusts work and why Arizona's trust laws make this strategy particularly interesting:

Americans are living longer, and that shift is reshaping how we think about estate planning. Recent data shows life expectancy in the U.S. has climbed to nearly 79 years, continuing an upward trend after recent declines during the COVID-19 pandemic.

This means individuals and families must prepare for longer retirements, extended care needs, and more complex planning decisions over time. Swipe through to learn more.

If your current plan does not reflect these realities, or if it has been some time since your last review, now is the time to revisit it. Contact us today to discuss how we can help you plan for the future with confidence.

You disputed an error on your credit report. What happens next?

The Fair Credit Reporting Act (FCRA) gives consumers important rights when credit reports contain inaccurate, incomplete, or unverifiable information—but an FCRA case usually involves several steps before a lawsuit is filed.

Our graphic breaks down the process from dispute and investigation through potential litigation.

🔹 Demand/Dispute: The credit bureaus and/or companies furnishing the information are notified of the problem and asked to correct it.

🔹 Investigation: The disputed information must be investigated within the time permitted by law.

🔹 No correction? If inaccurate information remains after the dispute process, there may be grounds for an FCRA claim depending on the circumstances.

🔹 Pre-suit review: Credit reports, dispute letters, investigation results, correspondence and evidence of damages are reviewed.

🔹 Litigation: When appropriate, an FCRA lawsuit may be filed seeking relief available under federal law.

One of the most important things consumers can do is keep everything—credit reports, dispute confirmations, letters, emails, investigation results and documentation showing how the inaccurate reporting affected you.

An error on a credit report isn't always just an inconvenience. It can affect your ability to obtain a mortgage, finance a vehicle, rent a home or obtain credit.

If you've repeatedly disputed inaccurate information and it keeps coming back—or was never properly corrected—it may be time to have the situation reviewed.

Many people assume that bankruptcy attorneys only help clients file for bankruptcy. The reality is that a bankruptcy lawyer can often help you explore a variety of debt-relief strategies before deciding whether bankruptcy is the right solution.

Here are several ways a bankruptcy attorney may be able to help beyond filing a bankruptcy case:

🔹Evaluate alternatives to bankruptcy and determine whether another option may be better.
🔹Review your income, expenses, assets, and debts to understand all available paths forward.
🔹Explain the differences between Chapter 7, Chapter 13, and other potential solutions.
🔹Help stop creditor pressure by providing guidance on your rights and protections.
🔹Assist with negotiations involving creditors or settlement discussions when appropriate.
🔹Identify strategies to help protect important assets while addressing financial challenges.
🔹Provide a clear understanding of the potential long-term impact of each option.

If you are struggling with debt and are unsure of your next step, contact us today. We are here to answer your questions, explain your options, and help you move toward a stronger financial future.

🚨 DEBT COLLECTORS CAN’T DO THAT.

Being contacted about a debt doesn’t mean a debt collector can say or do whatever they want.

The Fair Debt Collection Practices Act (FDCPA) gives consumers important protections against abusive, deceptive, misleading, and unfair debt collection practices.

We put together this quick FDCPA Violations Guide to help you recognize some of the warning signs.

❌ Harassing or repeatedly calling you
❌ Contacting other people about your debt
❌ Calling at prohibited times
❌ Making false or misleading statements
❌ Failing to provide required validation information
❌ Threatening action they cannot legally take—or don’t intend to take
❌ Sending deceptive communications
❌ Attempting to collect unauthorized fees or interest

Think a debt collector crossed the line? Save the evidence.

Keep the letters and envelopes. Screenshot texts. Save emails and voicemails. Keep a log of calls.

Then have the situation reviewed.

⚖️ Know your rights. Hold debt collectors accountable.
