To potential clients who are doing DIY or online estate planning documents:

The role as your attorney is to draft your estate planning documents from the ground up after we have a thorough, in-person (or virtual) consultation where I can fully understand your assets, family dynamics, goals, tax situation, and any unique issues that need to be addressed. I do not review homemade documents.

Here’s why I follow this policy:
• It is not ethical for me to give piecemeal advice on documents you drafted yourself. Once I start reviewing your work, I could inadvertently create an attorney-client relationship (and the liability that goes with it) without the benefit of a complete picture of your situation. That puts both of us at risk.
• Even well-intentioned DIY documents frequently contain subtle but critical errors—missing or incorrect language, improper ex*****on, outdated tax provisions, or provisions that conflict with current state law—that only become apparent after a full review. Spot-checking them would not serve you well and could actually create a false sense of security.
• We would still need a thorough consultation anyway. Estate planning is highly individualized. A proper plan requires me to ask dozens of questions you may not have considered, review all your assets and beneficiary designations, and coordinate everything into a cohesive set of documents. Simply “critiquing” what you already have doesn’t replace that process; it would just add an extra, inefficient step.
• It is not good practice for the client or the attorney. Experience shows that trying to “fix” DIY documents almost always takes more time and costs more in the long run than starting fresh. Drafting clean, professionally prepared documents tailored to your current circumstances is far more reliable, efficient, and protective of your family.
