Today marks the 50th anniversary of the Individuals with Disabilities Education Act (IDEA)—landmark legislation that opened the doors of public education to millions of children with disabilities.

Before IDEA, over 1.8 million children were denied access to public school. IDEA changed that by guaranteeing:

I often hear the complaint that attorneys do not call people back. Well, this is true, but there’s a reason for it. Most attorneys who do not respond to people that contact them for help lack a strong and organized process for dealing with prospective clients. Not us! We respond to you. Give is a try.

Timely access to an attorney when you need them is empowerment. Would you pay a monthly fee to have an experienced attorney on retainer? How much are you willing to pay? $2, $3, $5 per day?

I am not talking about prepaid legal services memberships—but rather, I am talking about the classic retainer model that ensures an attorney is available to communicate with you, give you advice, and step up as your attorney in a legal issue when you need that help.

I find there are so many resources online that purport to answer legal questions for free, for a one time fee, or for a monthly membership fee.

These services generally give basic information. Even the services you pay for do not and cannot represent you in a legal matter if and when needed. Some of these services charge you to get an answer from an attorney not even licensed in your state (i.e. useless advice). Often you pay for incomplete, inaccurate, or unhelpful advice.

If you try calling a private attorney’s office, on the other hand, you are lucky to get a call back from an attorney. So how do you empower and protect yourself and your family by having access to an attorney when you need one? An attorney on RETAINER, of course.

I am interested in hearing about your experiences trying to access an attorney when you have needed legal advice. I am also interested in hearing what you perceive to be the value of having a personal attorney on retainer. What fee per month are you willing to pay to secure the availability of an attorney for you?

People first. This time of year we see multiple job separations because employers are trying to trim the cost of their workforce going into the new year.

If anything I write “sticks,” let it be this: Hire an attorney to review your separation and proposed separation agreement. This is an investment in yourself. Your employer typically has numerous attorneys on their payroll. Have one for yourself as well. You do not need to have a court case to engage an attorney for this sort of service.

Below is a non-exhaustive list of things to lookout for in these agreements:

1. Separation/ Severance Payments—These need to be worded in precise language that does not disqualify you from receiving unemployment;
2. Payment of accrued time off—Ensure you get what the law requires you to get. Your employer is not necessarily required to pay out unused sick leave but this depends on how the employer has characterized this type of leave.
3. Bonus and Commissions—Employer agreements and practices are not always legally compliant. You might be entitled to a payout even after you are separated.
4. Non-competes & Non-solicitations—In many instances these are enforceable. Have these carefully reviewed. Your ability to work in the future is one of your super powers.
5. You Can’t Bad- Mouth Your Employer Clauses—Increasingly these clauses are being found to not be enforceable but this depends on your specific facts.
6. Secrecy of Separation Agreement—Increasingly these clauses are being found to not be enforceable but this depends on your specific facts.
7. Verification of Employment—You will want a neutral process explicitly outlined.

Bottom line: You deserve the best. Have your separation circumstances and agreement reviewed. I offer flat rates for this type of work so you always know up front what you are paying for.
