The Philippine Embassy in Washington DC, USA has shared reports that the U.S. Department of State is reviewing certain B1/B2 visas issued to individuals who later applied for asylum. Visa revocations may occur on a rolling basis.

βš–οΈ What is being reviewed?
The issue is generally not asylum itself, but whether the B1/B2 visa was obtained as a temporary visitor visa while the person's true intent was already to remain in the U.S. and seek immigration benefits. U.S. authorities may review cases for fraud, willful misrepresentation, or ineligibility for the visa classification.

❌ An asylum case may be denied or terminated if: β€’ The claim is found to be fraudulent or based on false statements;
β€’ The applicant cannot establish a legitimate fear of persecution under U.S. asylum law;
β€’ The applicant is subject to legal bars to asylum eligibility; or
β€’ Evidence shows material misrepresentations were made during the immigration process.

The Philippine Embassy advises Filipino nationals in the United States to remain informed of recent developments in U.S. immigration and visa policies and to ensure compliance with applicable U.S. immigration laws.

Recent reports indicate that the U.S. Department of State has begun reviewing B1/B2 business and tourist visas issued to foreign nationals who subsequently applied for asylum in the United States, with visa revocations expected to be undertaken on a rolling basis.

Filipino nationals who have concerns regarding their current immigration status are strongly encouraged to consult a qualified U.S. immigration attorney or an accredited legal service provider for advice appropriate to their individual circumstances.

The Embassy reminds the Filipino community that immigration cases are determined by the appropriate U.S. authorities based on the circumstances of each case.
