Recently in my career I have begun more frequently probating wills I drafted for people. That means they have died and I now have the honor of helping their family make sure the decedent's wishes are followed. I guess it's a natural progression from a practice perspective, but it's an odd feeling when I was the one who spoke with this person, got to know them, drafted the words, and then finally conducted the will ceremony. I think the best I can do, and probate lawyers in general, is to strive to make the entire process of probate a final act of respect to the decedent.

If Biden takes away or limits the step up basis rule at death, the results may be severe. It's no use playing the what-if game just yet, but this is something that could effect every home-owning American who dies, especially here in Westchester County.

There is nothing to do at this time, but definitely something for anyone who has the majority of their money in the equity of their home (most people) to keep an eye on.

Most people have been able to pass on assets like a family home without federal tax, but that could be changing.
