Today the Supreme Court granted a stay preventing OSHA from requiring COVID-19 vaccinations. In their holding, the Court stated, the People had not vested the executive branch with the authority to enact such broad health measures. “[The] universal risk [of COVID-19] is no different from the day-to-day dangers that all face from crime, air pollution, or any number of communicable diseases.”

In the concurring opinion by Justice Gorsuch, it is made clear that, “state and local authorities possess considerable power to regulate public health.” However, the federal government does not. Furthermore, the ability to regulate public health is left to the legislative branch. Justice Gorsuch went on to say:
“The question before us is not how to respond to the pandemic, but who holds the power to do so. The answer is clear: Under the law as it stands today, that power rests the States and Congress, not OSHA. . . [W]e only discharge out duty to enforce the law’s demands when it comes to the question who may govern the lives of 84 million Americans. Respecting those demands may be trying in times of stress. But if this Court were to abide them only in more tranquil conditions, declarations of emergencies would never end and the liberties our Constitution’s separation of powers seeks to preserve would amount to little.”

The purpose, of the Constitution and the Courts, is to protect the People. A judge must always have the rights of the People in his/her heart and mind. And must never allow the Rights guaranteed of the People to be infringed.
