Divorce does not need to be difficult. If you and your spouse are in agreement about divorce and know how you want to divide your assets and debts and how to share time with your children, then filing a joint petition for divorce may be the best option to dissolve. It has been said “when a child is 12 (or 14) years old they get to decide who they live with.” In Michigan that is simply not true. There is no age that Michigan Court deem that a child’s decision is the only factor in a decision to change custody or parenting time. The child’s preference is only one of 13 factors the court can consider in changing or establishing custody. Also, the court will consider the child’s age and maturity in weighing that single factor.
