This week we are at the Advanced Institute hosted by The Estate Plannjng Source in Green River, WY.

No court control is my all time favorite. Save on probate fees, and the negative emotional impact on your family.

-Joint Tenants vs. Tenants in Common-

When selling or transferring property to more than one person, the deed must confirm whether the individuals are taking title as joint tenants or tenants in common.

Do you know how your real property title is held?

Tenants in common is when you hold the property as co-owners. Your particular interest in the property will pass to the heirs of your estate.

Joint tenants is when you hold the property with a right of survivorship, meaning the property passes immediately upon the death of either joint tenant to the surviving joint tenant.

Advantages of holding title as Joint Tenants (JT):
• Surviving JT acquires title without the expense of probate proceedings
•JT between spouses will not trigger a taxable gift
• Title vests immediately to survivor JT

Disadvantages of holding title as Joint Tenants:
• You give up sole control of the property
• The surviving JT may not be the intended beneficiary
• Their may be unintended disinheritance of children depending on who passes first and the family dynamic
• Probate is inevitable, you are just delaying the process till the surviving spouse passes
