Incorporation and the Chicago Residential Landlord Tenant Ordinance (RLTO). I recently started representing a couple who was leasing a condominium to a law student who is now an attorney. I was retained because she is suing the landlord under the RLTO claiming they did not provide proper documentation of things like security deposits, minimal code violations of the association, and a failure to disclose contact information for the condominium management company. What is worse is this tenant, now an attorney, is doing this clearly for a money grab. The attorneys' fees exceed the amount of the damages claimed in the suit, which my clients may be individually liable for. Potential cost of suit could exceed $50k. PLEASE talk to an attorney such as myself before leasing anything! My clients could have sheltered themselves by doing a few things years ago that my cut into their small "Mom & Pop" enterprise. These include: putting the unit into an LLC or trust, being more diligent about "dotting Is and crossing Ts", and having disclosure acknowledgments drafted and signed. If you or anyone you know is leasing anywhere in the Chicagoland area, then please have them plan ahead by calling an attorney ahead of time to properly plan ahead for these potential money grabs. A small upfront expense can save a lot of money down the line in the future!

Yesterday was a red letter day for the Law Offices of JWL. We dismissed a foreclosure proceeding on a 2-619 (affirmative matter) motion. The Judge agreed our client was a bona fide purchaser for value (BFP) after the first lienholder released its lien. Plaintiff then attempted to rescind the release and file a separate foreclosure proceeding attempting to strip our client of its property rights. The Judge agreed our client had superior rights in the property and dismissed the case. We will likely also be recovering attorney's fees under the prevailing party statute of the Illinois Mortgage Foreclosure Law (IMFL).
