Secure Communities, Sanctuary Cities and the Role of ICE Detainers

Immigration and Customs Enforcement (ICE) contends that its Secure Communities program and use of detainers are essential to its ability "to protect the safety and security of the communities it serves."

Initiated under President Bush and expanded under President Obama, Secure Communities is an ambitious surveillance program under which millions of fingerprint records submitted to the FBI by law enforcement agencies are automatically passed along to ICE to match against its records. Where a match occurs, the immigration agency then decides whether to issue a "detainer" notifying the local law enforcement officials to hold the noncitizen so that ICE can take the person into custody for deportation.

U.S. DEPARTMENT OF HOMELAND SECURITY ends temporary residency permits for Nicaraguans, defers on Hondurans
“The Trump administration is planning a January 2019 end to a temporary residency permit program for 5,000 citizens from Nicaragua who have lived in the United States for almost two decades.
The administration is also postponing a decision until next July on how to deal with a similar program for 86,000 residents from Honduras.
The TPS program currently covers 435,000 people from 9 countries ravaged by natural disasters or war and who came to the U.S. —legally or otherwise— during the period their countries were covered by the presidential decree.
While the status was meant to be temporary, it was repeatedly renewed by the Bush and Obama administrations over concerns that the countries could not cope with the repatriation of so many people former residents.
Since taking office, Trump has ended the temporary permit program for Sudan and issued a shorter-than-usual renewal for nearly 60,000 Haitians, who were designated for temporary permits after the devastating 2010 earthquake.
Immigrants from Honduras and Nicaragua have been able to renew their temporary permits every 18 months since 1999, when both countries were given TPS status by the Clinton administration due to destruction from Hurricane Mitch a year earlier.
The Congressional Research Service said this month that only 57,000 people from Honduras and 2,550 from Nicaragua were expected to renew their TPS status.” PBS NEWS HOUR

Now, USCIS officers will be encouraged to redetermine every petition extension as if it was a new filing.

Applying for employment-based green cards will be a more drawn out process starting Oct. 1. The US Citizenship and Immigration Services will require applicants to have an in-person interview — something that has typically been waived to speed up a nearly year-long process. The administration, which also hopes to curb H-1B visas, has been cracking down on immigration policies, much to the frustration of tech companies. Tech companies, which depend heavily on foreign workers with specialized skills, argue they would rely on H-1B visas less if the process was simpler for employment-based green cards.

Implementation of President Trump's Executive Order Following the U.S. Supreme Court’s Ruling

On June 26, 2017, the Supreme Court granted certiorari and consolidated two key cases in the travel and refugee ban litigation. The Court clarified that the sort of "bona fide relationship" that qualifies for individuals is a "close familial relationship" to a person in the U.S. As for a "bona fide relationship" to a U.S. entity, the Court indicated that the relationship must be “formal, documented, and formed in the ordinary course.” The Court also held that a refugee with a credible claim of a "bona fide relationship" with a U.S. person or entity may not be excluded, even if the 50,000 cap on refugees has been reached.
