👨‍👩‍👧‍👦 Many parents believe naming their kids in a will is enough. In Colorado, it isn’t. When minors inherit through a will, the court takes control and money can be released at 18 with no safeguards. A trust keeps protection where it belongs.

🚨 What happens in the first 48 hours after a crisis? A stroke, a fall, an emergency call in the middle of the night. In those moments, families don’t need guesses, they need answers.

Who can make medical decisions? Who can access accounts? Does anyone know where the estate plan is, if it even exists? I see this constantly. Plans drafted years ago, sitting on a shelf, outdated, or impossible to locate when it actually matters.

Estate planning isn’t just about signing documents once. It’s about having clear instructions, immediate access, and an updated plan that works in real life, not just on paper.

⚖️ This surprises many parents. Guardians can make daily decisions but can’t touch money unless the court allows it. That delay causes stress when families need help most. A trust gives the right authority to the right people.

🧠 The fastest way to tear a family apart isn’t just money, it’s choosing the wrong person as your power of attorney or trustee. In January, families get together, the conversation comes up, and many people default to naming the oldest child. But in Colorado, power of attorney is not an honor, it’s a job with real responsibility.

I see it all the time one sibling drowning in pressure, unsure what their parents would have wanted, and resentment builds fast. The right choice isn’t always the favorite. It’s the person with the mindset, organization, and capability to handle decisions calmly.

That’s why good planning includes naming successors, discussing co agents or co trustees, and making sure every role is intentional before a crisis hits.

👨‍👩‍👧 Estate planning doesn’t stop at naming people. This mistake only shows up during a crisis. Parents name a guardian in a will and assume their kids are protected, but here’s the legal truth in Colorado: a guardian does not have access to the money.

Guardians can care for children, but they can’t pay bills, access life insurance, or manage assets while probate is pending. A guardian is not a trustee, and a guardian is not an executor.

As a mom and an estate planning attorney, I don’t leave this to chance. Real protection means clear asset paths, financial guardrails, and authority that actually works when it’s needed.

If guardianship is on your 2026 to-do list, don’t stop halfway.

🏠 Adding your child’s name to your house feels like an easy January fix, but it’s one of the most expensive estate planning mistakes families make.
The moment their name goes on title, your home becomes their legal asset too.

That means exposure to divorce, bankruptcy, lawsuits, tax debt, or creditors. And while many families do this to “avoid probate,” it often creates far bigger problems instead.

There is a safer way to keep control of your home, avoid probate, and protect it from outside risks without losing ownership or triggering taxes.

👉 Comment “trust” under this video and we’ll send you info on how to protect your home the right way plus details on our limited 10% discount available through February 14.
