A client of ours recently reached out after reading the demand letter we prepared for the insurance company on her behalf. We wanted to share what she wrote, because it says something about how we approach every case:

“Hi Mr. Lomena,

I just finished reading the demand letter, and I wanted to let you know how impressed I am with it. You did an incredible job capturing not only the details of the accident and my injuries, but also the very real impact this has had on my daily life.

Reading it was emotional because it accurately reflects the pain, limitations, and challenges I’ve been living with since the injury. I felt like my story was truly heard and understood.

Thank you for the time, effort, and care you put into preparing this. I believe it presents my case exactly as it should be presented, and I am very grateful for your work and representation.”

Too often, demand letters are little more than a brief summary of the incident, a list of diagnoses pulled from the medical records, the amount of the bills, and a request for the insurance company to name a number. Then when the offer comes back low, the insurance company or the defense attorney gets blamed for being unreasonable. But if you never told your client’s story in the first place, you never gave the adjuster a reason to see the case as anything more than a chart and a bill.

The demand letter is where your client’s story is either told or lost.

I recently attended the Colorado Trial Lawyers Association convention in Vail, and as always, I left inspired.

I love hearing great trial lawyers talk about their strategies, their cases, and some truly incredible verdicts. But this year, I found myself thinking about the younger attorneys in the room—the ones who haven’t tried their first case yet.

They hear about the victories. What they don’t always hear about is the fear that came first.

Trial is scary.

Nearly 20 years into doing this, I still feel that fear. I’ve just learned that it doesn’t mean you aren’t ready. It means you care. And if you use it correctly, it makes you prepare harder, focus more deeply, and ultimately become a better trial lawyer.

I wrote about that experience in Trial Talk for the young attorney who may be staring down their first trial.
