Starting today, Waymo is opening its fully driverless ride service to the public in Denver. The rollout will begin gradually across roughly 60 square miles of the city.

It’s pretty remarkable technology. But from our perspective, there’s an equally interesting question: What happens when a car with nobody behind the wheel causes a crash?

Colorado law already accounts for autonomous vehicles, and removing the human driver does not remove responsibility when someone gets hurt. It may just change where we have to look for it.

After a drunk driving crash, responsibility may not stop with the driver.

Colorado’s dram shop law is narrow, but in certain cases, a bar, restaurant or other licensed alcohol vendor can be held accountable for knowingly serving someone who was visibly intoxicated before that person caused serious harm.

The deadline matters, too. Dram shop claims in Colorado generally must be brought within one year, which is much shorter than many people expect.

You can do everything right on the road and still be left exposed after a crash.

Colorado has the highest underinsured motorist rate in the country at 49.7%. The Insurance Information Institute also lists Colorado as the ninth-highest state for uninsured motorists, with 19.7% of drivers uninsured in 2023.

That means the driver who hits you may not have enough insurance, or any insurance at all, to cover the damage they cause.

This is why uninsured and underinsured motorist coverage, often called UM/UIM coverage, matters so much. It is protection you put in place before a crash happens, so you are not forced to depend on someone else’s insurance after your life has already been disrupted.
