This is what a good day's work looks like. Last week, Ricky Nolen, Amanda Tynan, Kyle Thompson, and Tanner Davis from HHMR joined the Home Builders Foundation's Blitz Build to construct an accessibility ramp for Andrea.

The result was much more than a ramp.

For the first time in years, Andrea can leave her home by herself. She doesn't have to wait for someone to help her or plan her day around the barrier at her own front door.

HHMR is proud to be a continuing sponsor of Blitz Build and a supporter of the Home Builders Foundation. We're also especially proud of Ricky, Amanda, Kyle, and Tanner for rolling up their sleeves and representing our firm.

The Colorado construction industry builds homes and communities every day. Through HBF, it also comes together to build independence for people who need a little help making their homes work for them.

Who pays for the defense while everyone is still figuring out who was at fault?

Colorado's traditional duty-to-defend cases provide one answer. Colorado's construction anti-indemnity statute may complicate it.

The problem is that a defense is needed at the beginning of a case, while the fault that may determine permissible risk transfer often isn't known until much later.

Colorado's appellate courts have not squarely reconciled those principles.

HHMR founding member David McLain takes a closer look at this unresolved issue in our latest Colorado Construction Litigation Blog:

Colorado’s construction anti-indemnity statute creates an unresolved tension between the duty to defend now and allocating defense costs based on fault later.

Could bringing a weak Colorado Consumer Protection Act ("CCPA") claim end up costing a plaintiff more than they expected?

Colorado law allows courts, in certain circumstances, to award attorneys' fees against plaintiffs who pursue CCPA claims that lack substantial justification. Our latest blog explains how the statute works, discusses the recent case law, and highlights why this issue matters to businesses, insurers, and the construction industry.
