⚠️ New USCIS Policy Alert — Don't Panic. Here's What You Need to Know (sigue en español):

USCIS just issued a new memo saying that applying for a green card from inside the U.S. will now be treated as "extraordinary relief" — meaning even people who qualify may face more scrutiny and could be denied. This sounds scary. But here's the truth:

✅ This is NOT a new law.
✅ It does NOT eliminate any green card category.
✅ We believe it goes beyond what the law allows — and a legal challenge is likely coming very fast.

We've seen this before. This administration has issued dramatic policy announcements that ultimately changed very little. Moves like this are designed to frighten people into leaving the U.S. voluntarily. We will have to wait and see what, if anything, actually changes about how USCIS adjudicates cases.

📢 New 2025 Naturalization Civics Test:
USCIS is making changes to the civics portion of the naturalization test to make it more difficult. If you’re eligible and thinking of applying for U.S. citizenship, consider doing it now!

Here are the key changes to be aware of:

What’s New:
• There will be 128 civics questions to study (currently there are 100 questions).
• Applicants must now answer at least12 questions correctly (out of 20) to pass the test (rather than 6 out of 10 in the current version of the test).
• There are still special exceptions for applicants who are at least 65 years old and have been permanent residents for at least 20 years.

When does this go into effect?
• Anyone who files 30 days + after the new rule is published (likely tomorrow) will take the new, longer version of the civics test.
• Anyone who files less than 30 days after the new rule is published will take the current, shorter version of the test.

⚠️ Important Travel Alert for Green Card Holders!

We’ve been receiving many questions from permanent residents about whether it’s safe to travel outside the U.S. right now.

In general, travel is safe if you are a green card holder, but you should consult with an immigration attorney if any of the following apply to you or you have other concerns:

➡️ You have spent more than 6 months outside the U.S. in any given year since obtaining your green card.
➡️ You are in removal or deportation proceedings.
➡️ You have a criminal history since becoming a permanent resident (other than minor traffic violations).
➡️ There’s any indication that the current Administration could view your presence in the U.S. as having “adverse foreign policy consequences.” This could include accusations of inciting violence or supporting terrorism. Recently, individuals involved in pro-Palestinian activities have been targeted.
➡️ You are a citizen of a country that may be included in a potential new travel ban. List of countries here: https://www.reuters.com/world/countries-considered-trumps-potential-new-travel-ban-2025-03-15/

⚠️ Be Cautious at the Border:
There are numerous reports of returning permanent residents being extensively questioned, having phones and devices seized and searched, and even coerced into signing documents to voluntarily abandon their green card.

‼️ DO NOT sign anything you do not fully understand. If you have any concerns about traveling, schedule a consultation with a trusted immigration attorney before leaving the U.S.

Hemos recibido muchas preguntas de residentes permanentes sobre si es seguro viajar fuera de EE. UU. en este momento.

UPDATE to the post below - thanks to a lawsuit filed by several American Immigration Lawyers Association attorneys, USCIS has now implemented a grace period of several weeks for these forms. 🎉

Several updated immigration forms were released Monday and Tuesday, with no advance notice and no grace period. That means if you mailed in filings in the past few days, the filings may get rejected. In addition to making more work and expense for clients and attorneys and even USCIS, law enforcement will have to re-do many signed U visa certification forms signed on the old version of the form. All of this hassle and inefficiency is so USCIS could change “gender” to “sex” on the forms and remove the option for “other gender identity.” 😣

The U.S. Citizenship and Immigration Service updated forms without notice Monday, potentially affecting hundreds of applicants.

🔹 Actualmente, no existe un proceso para registrarse.

🔹 Podrían estar exentos aquellos que ya hayan sido registrados con huellas dactilares por el gobierno federal y posean uno de los siguientes documentos:
✔️ Registro de llegada/salida I-94 (titulares de visa y ciertos casos de parole)
✔️ Tarjetas de cruce fronterizo (algunos canadienses y mexicanos)
✔️ Notificación de Comparecencia u Orden de Causa Justificada (personas en proceso de deportación)

On February 25, the Trump Administration announced plans to enforce an outdated law requiring certain immigrants to register with the federal government and carry proof of registration at all times—or risk fines and/or jail time.

❗ What You Need to Know:
🔹 There is currently no process to register.
🔹 It remains unclear who will be required to register.
🔹 Exemptions may apply to those who have already been fingerprinted by the federal government and possess one of the following:
✔️ I-94 arrival/departure record (visa holders & certain parolees)
✔️ Border Crosser Cards (some Canadians & Mexicans)
✔️ Notice to Appear or Order to Show Cause (those in removal proceedings)
✔️ Permanent Resident Card ("green card")
✔️ Employment Authorization Card (work permit)
✔️ Certain other immigration documents

⚠️ This policy could put some immigrants in a tough position:
1️⃣ Register and risk detention and removal.
2️⃣ Avoid registration and risk criminal prosecution.

🔍 What Should You Do?
📌 There is no way to register yet—further guidance from the government is expected.
📌 If this policy may apply to you, consult with an experienced immigration attorney immediately to understand your rights and options.
