The erosion of workers' rights can come from many places. Here, HKM Founder and Managing Partner Daniel Kalish, highlights how even when a worker wins in court on a noncompete, the legal fees alone can bankrupt them. A company's resources will always outweigh an individual's resources - which is why it is so important that stronger safeguards for employees are in place. HKM is in favor of banning non-competes, because freedom to work supports our economy from the bottom up and middle out.

A slew of business groups joined the US Chamber of Commerce in opposing the Federal Trade Commission’s proposal to ban non-compete agreements, arguing it would limit their ability to protect confidential information.

Jury trial win report! Last week, Shelby Woods and Claire Hunter (with their paralegal Jenny Kern) went to trial in federal court representing a disabled employee who was discriminated against because of her disability. The jury of 10 unanimously found that the disabled employee was retaliated against and terminated in violation of the Americans with Disabilities Act. It was a just result for a deserving individual. Congratulations to our client and the Denver HKM team!

While more sunlight on government activities is always better, said Jesse K. Fishman, an employment law attorney at HKM Employment Attorneys in Denver, she hopes the bill, if it were enacted, would result with more whistleblowing on wrongdoing.

“The only potential downfall is how those exceptions play out. They could potentially be broadly construed,” said Fishman.

A first-term senator is pushing to ban the use of nondisclosure agreements for state employees in most circumstances, allowing them to speak freely about the circumstances of their employment.

We believe that employees should never be terminated because of their gender or because an employee has refused s*xual advances by a supervisor. Shelby Woods, Partner at HKM Employment Attorneys, filed a case demanding justice for her client.

A former Delta County Memorial Hospital nurse alleges that she was fired in March of last year—just days after getting promoted—because she turned down the s*xual advances of her supervisor.

For years, we have been arguing that Title VII’s protection extends to those who suffer discrimination based upon s*xual orientation and gender identity. The Supreme Court’s ruling ends that as a mere argument and makes it law.

The court said the language of the Civil Rights Act of 1964, which prohibits s*x discrimination, applies to discrimination based on s*xual orientation and gender identity.
