What actually happens after you file a civil lawsuit in Colorado? Most people assume a lawsuit means you’re headed straight to court. In reality, that’s rarely how it works. Here’s the typical path:

• Filing: The lawsuit is officially opened with the court
• Response: The other side answers, and the core issues are set
• Discovery: Both sides exchange documents, questions, and testimony
• Mediation/Settlement: Many cases are resolved here without trial
• Trial (if needed): A judge or jury makes the final decision

Most civil cases don’t end in a courtroom verdict. They resolve somewhere in the process long before that.
The key is understanding what happens at each stage so expectations match reality from the start.

𝗟𝗲𝗴𝗮𝗹 𝗙𝗔𝗤𝘀 | What’s the difference between mediation and arbitration?

Mediation is a guided negotiation where both sides work toward a mutual agreement. Arbitration is more like a private court where an arbitrator makes a decision that is often binding.

Understanding your dispute resolution options can help save time, reduce costs, and avoid unnecessary litigation. At Strickler Catlin LLC, we help clients evaluate the best path forward for resolving business and legal disputes. Contact us in Boulder County, Colorado.

They can. If emails clearly outline terms and show mutual agreement, they may be enforceable. That said, a formal written contract is always the safer approach.

𝗬𝗲𝘀 — Colorado is an “at-will employment” state, but there are important limits.

𝗕𝗮𝘀𝗶𝗰 𝗥𝘂𝗹𝗲
In Colorado, employment is generally presumed to be at-will, meaning an employer or employee can end the employment relationship at any time, for any lawful reason, or even for no stated reason, unless there is an employment contract that says otherwise.

𝗞𝗲𝘆 𝗘𝘅𝗰𝗲𝗽𝘁𝗶𝗼𝗻𝘀 (when you cannot fire someone)
Even in an at-will state, termination is illegal if it is based on things such as:
✅Discrimination (race, s*x, religion, disability, age, etc.)
✅Retaliation for reporting discrimination or harassment
✅Violation of public policy, such as firing someone for:
✔️Reporting illegal activity (whistleblowing)
✔️Filing a workers’ compensation claim
✔️Serving on a jury
✔️Taking protected leave (e.g., FMLA)

Also, an employer may lose the at-will protection if:
💠There is an employment contract or union agreement
💠An employee handbook or policy effectively promises certain disciplinary steps before termination.
