In May 2019, Colorado became the fifth state to enact their own net neutrality law by prohibiting internet providers from throttling or blocking otherwise legal content, services, and apps. The law also prevents broadband companies from establishing internet “fast lanes” for their preferred customers.

Although there are several recreation areas in Colorado where dogs are allowed to run free, Colorado Parks and Wildlife (CPW) strongly recommends keeping pets on a leash whenever there is a chance they may encounter wildlife. Pets are not allowed to chase wildlife in Colorado. Negligently allowing a dog to harass wildlife is an infraction that may subject dog owners to $274 in fines, including surcharges. When a dog kills a wild animal in Colorado, owners can be cited for an illegal take. The fine associated with an illegal take is $959 for a deer and $1,370 for an elk, including surcharges. Wildlife laws are often complicated, and the penalties can be severe. If you are a sportsman, landowner, outfitter, or pet owner who has been charged with violating these laws, you need to know your rights. Click on the link below to learn more.

After you have been arrested and put in holding, a judge will either set bail or release you on your own recognizance. Meanwhile, the local district attorney will review the case and decide whether they want to prosecute you. If so, the court will hold a formal reading of the charges against you, which is known as an arraignment. At this point, you definitely want to have a lawyer by your side. What follows is usually a negotiation between your defense attorney and the prosecutors, which can take weeks or even months. Most cases are resolved without ever going to trial. But, if you are tried for a crime, your attorney must convince the jury that you are not guilty – that there is reasonable doubt about you committing the exact crime you are being charged with. Don't go through this process alone - having a tough Colorado criminal defense attorney on your side can make all the difference. Click to learn more:

When it comes to Wildlife Wasteful Destruction, it doesn't matter if you are legally hunting, illegally poaching, or trophy hunting. You can be accused of this violation if you leave the animal behind, only take the antlers or head, or only take part of the body. In addition, a wildlife officer has the discretion to determine what is "waste" and what isn't, making it a purely subjective matter based on that person's opinion. Since, in some cases, the laws are not very specific, you can be caught in a situation where you can be wrongfully accused and/or your rights can be violated if you do not have a knowledgeable attorney defending you. Archery hunting is perhaps the fastest growing aspect of the outdoor industry. The challenge, the time of year and a host of other factors make pursuing an animal with a primitive weapon a thrilling experience. Archery hunting, however, includes incredible risks for wildlife violations. One risk is the willful destruction of the animal. Although no hunter wants to wound an animal with an arrow, it inevitably happens. A hunter may then pursue the animal only to find the carcass completely spoiled. The hunter may still choose to retrieve the trophy parts (i.e. the antlers). A Wildlife Officer may cite the hunter for Willful Destruction if he or she believes the edible portions of the animal were not retrieved. Selecting a lawyer who understands these issues is integral to your defense. Don't make the mistake of hiring a basic criminal defense attorney to protect your hunting privileges. Learn more:

An easement is a legal right to use someone else's property for a particular purpose. Cell tower and telecom companies have a vested interest in securing access to a cell tower site located on your property. To accomplish this, they will want a long-term easement that allows entry to the property whenever the company deems necessary. Every cell tower lease situation is unique. It is crucial to fully understand and skillfully negotiate the terms of a cell tower lease to protect your property interests. Lease forms presented by cell tower companies are typically one-sided to the detriment of the property owner. They are also lengthy and complicated legal documents. Our lawyers have the knowledge and experience to carefully evaluate all factors involved in a cell tower lease, including projected use of the property, tax considerations, and our client's desires, to help determine the best solutions under the circumstances. Colorado is a leading hotspot for car thefts, the third highest in the nation. First Degree Aggravated Motor Vehicle Theft, often called grand theft auto, occurs when a person obtains or exercises control over the motor vehicle of another without authorization or by threat or deception. It is accompanied by one of many aggravating factors and often has harsh penalties imposed in a conviction. Second-Degree Aggravated Motor Vehicle Theft occurs when a person knowingly obtains or exercises control over the motor vehicle of another without authorization, or by threat or deception, and if none of the aggravating factors of First Degree Motor Vehicle Theft are present. For vehicles valued at less than $1,000, a misdemeanor may be filed, unless the accused has a criminal record for a similar offense. Learn more by clicking the link below.

For that avid fisherman, choosing to fish in their home state or another, you need to know all the state rules and regulations. It is more expensive for non-resident fishermen to enjoy the sport in most states. The falsifying of any license or document, just to save some money, can be extremely expensive if discovered. Licensing rules and regulations are very specific as to what type of fish you can catch, where you can catch them, and what time of the season you may do so. Fishing rules and regulations can be more complex than you might imagine. Violating them can result in stiff penalties as well as possible suspension of hunting and fishing privileges. Driving under the influence is a severe offense and becomes even more severe when someone is hurt in a DUI accident. If you are facing charges of vehicular assault (DUI causing injury) or vehicular homicide, it is important to fight aggressively against the charges. Depending on the specific offense and the circumstances surrounding the incident, our Colorado criminal defense lawyer can raise legal defenses that may include the following:

🔴 You were not the person operating the vehicle.
🔴 You were not driving under the influence of alcohol or drugs.
🔴 Your breath test or blood test was not conducted properly.
🔴 The police violated your rights or failed to advise you of your rights.

Colorado is tough on driving under the influence, particularly when someone else is hurt or killed. You could go to prison upon conviction of DUI causing injury or vehicular homicide. At Welsh Law, LLC, we can examine the prosecution’s case against you for any flaw and raise every possible defense against the charges.
