Many people assume that if an asset is in one spouse’s name, it automatically belongs to that person. In Colorado, that’s not always the case. Property acquired during the marriage is generally considered marital regardless of whose name appears on the title.

That can include real estate, bank accounts, investment accounts, and retirement contributions earned during the marriage. Courts look at when and how assets were acquired, not just the name listed on the paperwork.
