Once trade secrets lose their secrecy, they lose their value. When calculating the damages for misappropriation, this loss in value should be considered. Because courts often don't see this lost value, under DTSA and UTSA, determining "monetary damages in trade secrets misappropriation cases is rarely easy."

Alternative methods of calculating damages that may reflect that actual cost includes the diminution in value and the cost in developing the trade secret. What are your thoughts?
