When a married person purchases or sells their primary residence as a sole owner, they often forget one thing … their spouse.

💡 In title insurance, many parties don’t realize this until they go into contract, which can lead to delays at closing.

🏡 Key points:

Purchasing: Spouses must sign the mortgage (not the note) to notify them that the homestead property has a lien.

Selling: Spouses must sign off their homestead rights before the sale can close.

✅ Protect your transaction and avoid surprises, make sure all required signatures are included!

Even though Florida’s Homestead automatically transfers to your spouse or heirs when you pass, your home could still become a probate asset, which may delay the transfer and create extra costs.

🏡 Solution: An Enhanced Life Estate Deed (Lady Bird Deed) allows you to: retain full control of your home during your lifetime and ensure your property passes automatically to your heirs without probate

✅ Protect your family, simplify your estate, and avoid unnecessary delays.

📞 Talk to us today about how an Enhanced Life Estate Deed can safeguard your Florida homestead.

💡 Florida’s Homestead protections don’t just save you on taxes. They can also shield your home from certain judgments, even when you sell.

🏡 Primary residence protection: Most creditor judgments cannot force the sale of your homestead.

⚖️ Exceptions: Mortgages, property taxes, construction liens, and certain federal debts.

When selling your home, these protections may impact the closing process if liens or judgments exist. Proper planning, including claiming your Homestead Exemption and working with a title insurance company (like us!), ensures a smooth, protected transaction.

📞 Selling your home? Talk to us today about how Florida Homestead laws and title insurance work together to protect your property.

🏡 Myth: You need to live in your Florida home for several years before you can qualify for the Homestead Exemption.

✅ Fact: If you make the property your permanent primary residence by January 1, you can apply for the exemption that same year!

No waiting period, just proof that the home is your true residence.
That means lower property taxes and strong legal protections right away.

📅 Deadline: March 1 for new applications.
