I fully endorse Win Graham in his endeavor for re election. He has shown to be a fair and impartial Judge . If it is not broken, do not fix it! If I have friends in Young County please vote for this man in the run off! Young County Judge.

Not being Judge might not be so bad. Since I have been working all week and was working the campaign on the weekend I now had time to go fishing and to the rifle range yesterday!

Hmmmm I think I’m through with politics . Always a bigger dog coming along after you anyways but in trial work reputation means all. Not bad!

The VIP Room was sponsored for years by a former GOP Chair and high profile Attorney in Wise County, Allen Williamson. Mark Ary had stepped in for the past few years and helped out, and we appreciate his support.

Now we are going back to the legacy of having the legal profession, not only represented in our membership, and other sponsorships, but back in the position of sponsoring the VIP Room.

I am following up on my legal post from yesterday regarding the U.S. Constitution on an unequivocal right to a trial by jury in a criminal prosecution. To ensure justice, that is why we have a prosecuting attorney, a defense attorney and a jury as well. We all have different responsibilities.

United States Constitution Sixth Amendment Regarding Criminal Cases:

Right to a jury: Guarantees a trial by an impartial jury for all criminal prosecutions.

The Texas Constitution guarantees the right to a jury trial in both criminal and civil cases through provisions in the Bill of Rights (Article I, Section 10) and the judiciary article (Article V, Section 17).

This right is protected by both the Texas Constitution (Article I, Section 10) and again by the Sixth Amendment of the U.S. Constitution.

I am often asked why a pre-supposed guilty person would ever have a jury trial. The question is answered in the above and below response.

Many people may not realize it, however, Jack Ruby, the person that “obviously” killed Lee Harvey Oswald in front of many witnesses actually had a jury trial. He was convicted, however, that conviction was overturned by a higher Court. Jack Ruby then died in custody awaiting his second jury trial that was guaranteed to him by the U.S. Constitution and the Texas Constitution.

For now my role in the justice system is to be a criminal defense attorney, as well as handling other matters. I have no problem becoming your next 271st District Judge and changing “hats.”

In fact, in the past, I have served as a special prosecutor in a criminal prosecution in the 271st Wise County District Court.
